Staff Summary
·      The Fiore Properties LLC has submitted an application to rezone .97 acres of land located on the northwest corner of N. Main St. and W. IL Route 22 from the Residential-1 (R-1) District to the General Commercial (GC) District.
·      The applicant intends to keep the existing use of the property as a wholesale nursery.
·      Following the public hearing on September 17, 2012, after due consideration, the ZBA recommended by a vote of 7-0 that this application be approved.
·      Planning, Building and Development Department also recommends approval.
 
Body
WHEREAS, a public hearing has been held by the Lake County Zoning Board of
Appeals pursuant to the Statutes of the State of Illinois on the petition of ATG Trust Company as Trustee UTD 5-14-2003 and known as Trust #10059, which requests a rezoning of PINs 15-21-100-004 and 15-16-307-006 from Residential-1 (R-1) to General Commercial (GC) for the following real estate, to-wit:
 
WHEREAS, your Department of Planning, Building, and Development duly considered the aforesaid petition and recommends that it be approved; and
 
WHEREAS, your Zoning Board of Appeals, after reviewing the testimony presented at
the public hearing on the aforesaid petition, has submitted its report thereon to the
County Board and its report recommends by a vote of 7-0 that the petition be approved.
and
 
WHEREAS, your Planning, Building and Zoning Committee duly considered the petition and reports aforedescribed and recommends by a vote of 4 to 0 that the petition be granted. Motion made by Member Hewitt, with a second by Member Carlson, to grant the petition. Voting "Aye" Carlson, Hewitt, Mountsier, Pedersen; voting "Nay", none.
 
NOW, THEREFORE, BE IT RESOLVED by the Lake County Board that the request of
the Petitioner for rezoning from Residential-1 (R-1) to General Commercial (GC) for
05-21-100-004 and 15-16-307-006 be granted.
 
BE IT FURTHER RESOLVED, that the Secretary of said Zoning Board of Appeals be
instructed to notify the Petitioners as to the action taken by the Board.
