Resolution authorizing the execution of two local agency agreements for the jurisdictional transfer of what are the new frontage roads to relocated Peterson Road at IL Rte 60, Behm Lane and Behm Park Lane, from Lake County to the Fremont Township Road District and requesting Illinois Department of Transportation approval.

 

Staff Summary

                     Peterson Road Jurisdictional Transfer: Lake County to Fremont Township Road District; Behm Lane and Behm Park Lane.

                     Peterson Road, in the vicinity of Peterson Road and IL Rte 60, is currently being reconstructed and realigned.

                     Portions of the existing Peterson Rd are being left in place to serve as frontage roads and are being renamed as Behm Lane and Behm Park Lane.

                     Behm Lane and Behm Park Lane will be removed from the County Highway System and transferred to the Fremont Township Road District.

                     These jurisdictional transfers are effective upon the IDOT approval.

R E S O L U T I O N

 

WHEREAS, Peterson Road, County Highway 20, in the vicinity of Peterson Road and IL Rte 60, is being reconstructed and realigned, and

 

WHEREAS, by operation of law i.e., 605 ILCS 5/5-107, the new location of Peterson Road as relocated in the vicinity of Peterson Road and IL Rte 60, shall become the location of County Highway 20, and  

 

WHEREAS, portions of the existing Peterson Road, upon completion of the re-alignment, are being left in place to serve as frontage roads, and

 

WHEREAS, pursuant to 605 ILCS 5/5-107 the Lake County Board, by the process established by law, may transfer road jurisdiction of a relocated county highway to another highway authority for any portion of the original location of a county highway not incorporated into the new location, hereinafter the frontage roads; and

 

WHEREAS, jurisdictional transfers of roadways in the state of Illinois require the approval of the Illinois Department of Transportation, IDOT, and for which process IDOT has a standard agreement form, and

 

WHEREAS, Lake County and the Fremont Township Road District are desirous of entering into two agreements, draft copies of which are attached hereto, for the jurisdictional transfer of the frontage roads from Lake County to the Fremont Township Road District, as depicted in the maps attached hereto as Addendum 1 to said agreements; and

 

WHEREAS, by previous resolution, this Lake County Board has changed the name of said frontage roads to Behm Lane and Behm Park Lane as depicted in the maps attached hereto as Addendum 1 to said agreements; and

 

NOW, THEREFORE BE IT RESOLVED by this Lake County Board that the Chair of the County Board, the County Clerk, and the County Engineer are hereby authorized and directed to process and execute any and all appropriate and related agreements with Fremont Township Road District, as required by IDOT, for said jurisdictional transfer of the frontage roads, and

 

BE IT FURTHER RESOLVED that the County Engineer shall transmit in writing the final agreements, and any amendments required by IDOT, to be executed by the County Board Chair and the County Clerk, and process said agreements and amendments to IDOT for their approval.

 

BE IT FURTHER RESOLVED that said jurisdictional transfer of the frontage roads is effective upon IDOT approval.
