Staff Summary
• 1100 Douglass, LLC, and Chicago Title Land Trust Company, as Successor Trustee to Trust #1871, the sole beneficiary of this land trust being Robert W. Conforti, Jr., record owners, are requesting vacation of an unimproved right-of-way located east of Drexel Boulevard, and between 38397 and 38383 N. Drexel Boulevard, Antioch, Illinois. The portion of unimproved right-of-way to be vacated is 50 feet wide, extends 278 feet east (average), and consists of 0.32 acres.
• The right-of-way has not been improved nor accepted by the Antioch Township Highway Commissioner. The Highway Commissioner has no objections to the proposed vacation, nor has any objection been received from public utility companies, however, a ten foot utility easement will be placed at the northwest corner of the vacated right-of-way at the request of Commonwealth Edison.
• The Board of Vacations held public hearings on December 4 and December 19, 2023 and recommended unanimously to grant the vacation.
• Following a recommendation by the Planning, Building, Zoning and Environment Committee, the vacation request will proceed to the County Board for final action.

RESOLUTION
WHEREAS, on December 4, 2023, and December 19, 2023, public hearings were held before the Board of Vacations pursuant to Section 151.204 of the Lake County, Illinois Code of Ordinances, as amended, on the petition of 1100 Douglass, LLC, and Chicago Title Land Trust Company, as Successor Trustee to Trust #1871, the sole beneficiary of this land trust being Robert W. Conforti, Jr., record owners, requesting a vacation of an unimproved right-of-way located east of Drexel Boulevard, 50 feet wide, that extends 278 feet east (average), and consists of 0.32 acres, located in the J.L. Shaw’s Subdivision on Fox Lake, Antioch, Illinois, and more fully described as follows:
All that part of the unnamed public road, lying between and contiguous to Lots 41 and 42 lying east of the easterly right of way line of Drexel Boulevard thereof extended northeasterly from the northeast corner of Lot 42 to the southwesterly corner of Lot 41 and lying northwest of the shore of Fox Lake Thereof in J.L. Shaw’s Subdivision on Fox Lake in section 35, Township 46 North, Range 9, east of the third principal meridian, according to the plat thereof recorded July 15, 1909 as document 123552, in Book “H” of Plats, pages 38, 39 & 40, in Lake County, Illinois; and
WHEREAS, the petitioners are the owners of the following parcels of real estate, to-wit:
The south half of Lot 40 and all of Lot 41, in the J.L. Shaw’s Subdivision on Fox Lake, in Section 34 and 35, Township 46 North, Range 9, east of the third principal meridian, according to the plat thereof, recorded July 15, 1909 as document 123552 in Book “H” of plats, pages 38, 39 and 40 in Lake County, Illinois, PIN 01-35-402-018; and
Lot 42 in J.L. Shaw’s Subdivision on Fox Lake, being a subdivision in Section 35, Township 46 North, Range 9, east of the third principal meridian, according to the plat thereof recorded July 15, 1909, in Book “H” of plats, page 38, as document 123552, in Lake County, Illinois, PIN 01-35-402-019; and
WHEREAS, after reviewing the testimony presented at the aforementioned public hearing of the Board of Vacations, said Board has submitted its recommendation and report to the Planning, Building, Zoning and Environment Committee; and
WHEREAS, the Board of Vacations recommends approval of the vacation request based on the following findings: 1. There is no current or future public need for the platted right-of-way evident 2. No objection was received from the Antioch Township Highway Commissioner, adjacent property owners, or utility service companies 3. The vacation will be a benefit to the adjacent property owners and the neighborhood 4. The applicant agreed to record a 10 foot utility easement as requested by Commonwealth Edison.
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the public right-of-way, as described above, is hereby vacated and that portion of said plats of subdivision are hereby revoked, annulled, and set aside; conditioned upon the recordation of a 10 foot utility easement as requested by Commonwealth Edison; and
BE IT FURTHER RESOLVED, that this resolution shall take effect and be in force for and after its passage provided that said petitioner shall after the passage of this resolution, file for recording in the office of the Recording Division of the Lake County Clerk’s Office, a certified copy of this resolution, the application, and the Deed of Vacation.
