Title

Joint resolution authorizing the execution of a 2010 Restated and Amended Agreement for Sewage Disposal with the Lakes Region Sanitary District.

 

Staff Summary

                     The County and the Lakes Region Sanitary District (LRSD) entered into an agreement for sewage disposal services within the Northwest Lake FPA on November 16, 2004.

                     The term of this agreement is for 30 years and is still current, however a restated agreement has been negotiated to expand and modify respective sewer related obligations between the parties.

                     This new restated agreement incorporates many modifications to promote and provide for the efficient and economical use of costly public infrastructure and address long term compliance issues in response to excessive inflow/infiltration, odor control, fats oils and grease, pretreatment coordination, externality fee, and coordination of regional system operations.

                     Coordination with the Village of Fox Lake as the provider of regional treatment services within the Northwest Lake FPA has been integral in the development of provisions for this wholesale sewage agreement.

                     This resolution authorizes the execution of a 2010 Restated and Amended Agreement for Sewage Disposal with the Lakes Region Sanitary District.

Body

                     WHEREAS, the County of Lake (County) owns and operates a system of interceptor sewers in the Northwest Lake Facilities Planning Area (NWFPA); and

 

                     WHEREAS, the Lakes Region Sanitary District (District) owns and operates a local sanitary sewer system in the NWFPA that discharges into and is transported to the Northwest Regional Water Reclamation Facility by the County interceptor sewer system; and

 

                     WHEREAS, the County and the District previously entered into a Restated and Amended Agreement for Sewage Disposal dated November 16, 2004; and

 

                     WHEREAS, in order to ensure the ability to develop long-range plans for providing sewerage services for future development and redevelopment of its territory, the District requires a long-term source for Sewerage Treatment services.  The Northwest Regional Water Reclamation Facility is the most effective source for such Sewerage Treatment services; and

 

WHEREAS,  in order to conform with the terms and conditions under which continued Sewerage Treatment services will be provided through the Northwest regional Water Reclamation Facility, the County and the District desire to enter this restated and amended agreement for sewage disposal that will permit the District, subject to specified terms, conditions, exceptions, and limitations, to deliver sewerage to the County’s sanitary sewer system in the Northwest Regional Area for Treatment services via the Northwest regional Water Reclamation Facility, which restated and amended agreement would supersede the Prior Sewage Agreement; and

 

                     WHEREAS, this Agreement incorporates many modifications to promote and provide for the efficient and economical use of costly public infrastructure, and address long term compliance issues in response to excessive inflow/infiltration, odor control, fats oils and grease, pretreatment coordination, externality fee, and coordination of regional system operations; and

 

                     WHEREAS, execution of a 2010 Restated and Amended Agreement for Sewage Disposal must be authorized by Resolution of this County Board; and

 

                     NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois that the Chair of the County Board and the Clerk of said County be and they are hereby authorized and directed to execute the 2010 Restated and Amended Agreement for Sewage Disposal with the Lakes region Sanitary District in substantially the form attached.
