RESOLUTION
WHEREAS, pursuant to authority granted by this County Board of Lake County, Illinois, the County Engineer heretofore called for sealed bids, by publication, for the improvements to the intersection of Deep Lake Road at Depot Street, which will include installation of a roundabout and non-motorized improvements, and is designated as Section 19-00132-05-CH; and
WHEREAS, pursuant to said publication and calling for said bids, sealed bids were received and opened December 9, 2025, at 10:00 a.m. at the Lake County Division of Transportation in Libertyville, Illinois; a tabulation of said bids being as follows:

WHEREAS, the Public Works and Transportation Committee, the County Engineer and the Purchasing Agent have examined each bid, and it appears that the lowest responsible bidder is Berger Contractors, Inc., Wauconda, Illinois, their bid being $2,867,174.87, based on estimated quantities and unit prices; and
WHEREAS, the project requires a 100-day closure of the intersection in order to construct the improvements; and
WHEREAS, the contract includes incentives to the contractor for opening the intersection early and disincentives if the closure goes beyond the planned 100 days; and
WHEREAS, an appropriation of funds is required.
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that a contract be awarded to Berger Contractors, Inc., Wauconda, Illinois, in accordance with their bid of $2,867,174.87, based on estimated quantities and unit prices, and that the Purchasing Agent, the County Clerk, and the County Engineer of Lake County be authorized and they are hereby directed to enter into a contract with said low bidder for the intersection improvement of Deep Lake Road at Depot Street and designated as Section 19-00132-05-CH; and
BE IT FURTHER RESOLVED, that the County Engineer, for the processing of contract change orders, is hereby authorized and directed to treat the awarded base construction cost as the low bid amount of $2,867,174.87 plus any detour incentives up to a maximum of $112,500; and
BE IT FURTHER RESOLVED, that in as much as such estimated quantities are the best approximation that can be determined at this time, these quantities may be added to, deducted from, or modified from in the final determination of the contract cost in accordance with Chapter 605 of the Illinois Compiled Statutes, Act 5, Section 5-205.2 without further board action, providing the final cost chargeable to the funds appropriated does not exceed the appropriation; and
BE IT FURTHER RESOLVED, that there is hereby appropriated $3,555,000 of County Option Motor Fuel Tax funds for these improvements.
