Joint resolution adopting the Capacity Management Operations and Maintenance (CMOM) Program for the Northwest Lake Facilities Planning Area (NWFPA).
 
Staff Summary
·      The County Board previously approved an Agreement for Sewage Disposal by and between the County and the Village of Fox Lake on July 15, 2010 (the Fox Lake Agreement).
·      As part of the Fox Lake Agreement, the County and the Village of Fox Lake, in consultation with the Wholesale Advisory Committee of the Northwest Lake Facilities Planning Area (the NWFPA WAC), were required to develop a Capacity Management Operation and Maintenance (CMOM) Program for the NWFPA, and established an "Annual CMOM Investment" to ensure a minimum needed for maintenance and repair of local sewage collection systems within the NWFPA and to control excessive inflow and infiltration.
·      The Villages of Hainesville, Round Lake, Round Lake Beach, Round Lake Park, Round Lake Heights, Lake Villa, the Lakes Region Sanitary District, and Harbor Ridge Utilities (the Communities) have agreements for sewage disposal with the County and all the Communities participate in the NWFPA WAC.
·      The County, Fox Lake, and the Communities through the NWFPA WAC have been implementing components of the CMOM Program for the NWFPA and pursuant to the CMOM Program for the NWFPA, and Annual CMOM Investment has been established for each entity involved in the collection, transport, or treatment of sewage in the NWFPA, which CMOM Program (inclusive of the Annual CMOM Investment) is set forth in Exhibit A attached hereto.
·      It is in the best interest of the County to adopt the "Annual CMOM Investment" as set forth in the attached CMOM Program.
·      This resolution adopts the program and authorizes implementation of the CMOM Program.

R E S O L U T I O N
 
WHEREAS, the Lake County Board previously approved an Agreement for Sewage Disposal by and between the County and the Village of Fox Lake (the Fox Lake Agreement) on July 15, 2010; and
 
WHEREAS, as part of the Fox Lake Agreement, the County and the Village of Fox Lake, in consultation with the Northwest Lake Facilities Planning Area Wholesale Advisory Committee (NWFPA WAC), were required to develop a Capacity, Management, Operation, and Maintenance (CMOM) Program for the NWFPA, and as part of the CMOM Program, establish an "Annual CMOM Investment" to ensure a minimum needed for maintenance and repair of local sewage collection systems within the NWFPA to control excessive inflow and infiltration; and
 
WHEREAS, the Villages of Hainesville, Round Lake, Round Lake Beach, Round Lake Park, Round Lake Heights, Lake Villa, the Lakes Region Sanitary District, and Harbor Ridge Utilities (the Communities) have agreements for sewage disposal with the County; and
 
WHEREAS, the County, Fox Lake, and all the Communities participate in the NWFPA WAC; and
 
WHEREAS, as part of the sewage disposal agreements, the communities will be adopting CMOM Programs and will be establishing an "Annual CMOM Investment"; and
 
WHEREAS, the County, Fox Lake, and the Communities through the NWFPA WAC have been implementing components of the CMOM Program for the NWFPA; and
 
WHEREAS, pursuant to the CMOM Program for the NWFPA, an "Annual CMOM Investment" has been established for each entity involved in the collection, transport, or treatment of sewage in the NWFPA, which CMOM program (inclusive of the Annual CMOM Investment) is set forth in Exhibit A attached hereto; and
 
WHEREAS, it is in the best interest of the County to approve and acknowledge the "Annual CMOM Investment" as set forth in the attached CMOM Program.
 
NOW, THEREFORE, BE IT RESOLVED by this County Board of Lake County, Illinois that:
 
Section 1.  Recitals.  The recitals set forth above are incorporated as part of this resolution by this reference.
 
Section 2.  Adoption of "Annual CMOM Investment".  The County hereby adopts the "Annual CMOM Investment" as set forth in the attached CMOM Program for the NWFPA.
 
Section 3.  County Administrator to Implement.  The County Board hereby authorizes and directs the County Administrator (together with the Lake County Public Works Department) to take necessary and appropriate steps to implement the CMOM Program for the NWFPA and to cause the County to meet its "Annual CMOM Investment" as set forth in the CMOM Program.
