Joint resolution adopting a Host Agreement between Veolia ES Zion Landfill, Inc., an Illinois Corporation and Lake County, Illinois and the Solid Waste Agency of Lake County, Illinois.
Staff Summary
·      The 2004 Lake County Solid Waste Management Plan, as amended, requires that an applicant proposing to site a pollution control facility in Lake County must first enter into host agreements with Lake County, SWALCO and the governing body (Zion, Illinois) before filing a siting application.  The attached agreement would fulfill this requirement.
·      The Host Agreement amends the existing 1994 Disposal Agreement to provide a capacity guarantee at the existing Zion Landfill for 2010 and 2011 and for additional host fee payments in 2010 and 2011.  
·      The Host Agreement provides for additional host fee payments beginning in 2012 and for six years of disposal capacity for up to 300,000 tons per year.
·      The Host Agreement allows for environmental audits and requires Veolia to maintain its Property Value Protection Plan and well monitoring program as contained in its host agreement with the City of Zion.
·      This is a three party Host Agreement and must also be approved by SWALCO to become effective.  SWALCO's Board of Directors is expected to take action on the Host Agreement at its meeting on January 28, 2010.
·      This resolution authorizes the County Chair and County Clerk to execute the Host Agreement between Veolia ES Zion Landfill, Inc., an Illinois Corporation and Lake County, Illinois and the Solid Waste Agency of Lake County, Illinois.

RESOLUTION
ADOPTING HOST AGREEMENT BETWEEN VEOLIA ES LANDFILL, INC., LAKE COUNTY, ILLINOIS AND
THE SOLID WASTE AGENCY OF LAKE COUNTY, ILLINOIS

      WHEREAS, the Solid Waste Agency of Lake County, Illinois; is a public body, and corporate; and
 
      WHEREAS, Lake County, Illinois is a public body and corporate; and
 
      WHEREAS, Veolia ES Landfill, Inc. is Illinois corporation that supplies certain landfill capacity and services; and
 
      WHEREAS, the Illinois Constitution and the Illinois Intergovernmental Cooperation Act (5 ILCS 220/et seq) provides for units of local government to enter into intergovernmental contracts for waste projects that provide for waste capacity and for compensation to areas affected by said waste projects; and
 
      WHEREAS, The 2004 Lake County Solid Waste Management Plan, as amended, requires that an applicant proposing to site a pollution control facility in the City of Zion, Lake County, Illinois must first enter into host agreements with Lake County, SWALCO and the governing body (Zion, Illinois) before filing a siting application; and
 
      WHEREAS, the attached intergovernmental Host Agreement would fulfill this requirement; and
 
      WHEREAS, the attached Intergovernmental Host Agreement amends the existing 1994 Disposal Agreement to provide a capacity guarantee at the existing Zion Landfill for 2010 and 2011 and for additional host fee payments in 2010 and 2011; and
 
      WHEREAS, the attached intergovernmental Host Agreement provides for additional host fee payments beginning in 2012 and for six years of disposal capacity for up to 300,000 tons per year; and
      
      WHEREAS, the attached intergovernmental Host Agreement allows for environmental audits and requires Veolia to maintain its Property Value Protection Plan and well monitoring program as contained in its host agreement with the City of Zion; and

      WHEREAS, this Resolution authorizes the County Chair and County Clerk to execute the Host Agreement between Veolia ES Zion Landfill, Inc., an Illinois Corporation and Lake County, Illinois and the Solid Waste Agency of Lake County, Illinois.
 
 
      NOW, THEREFORE, BE IT RESOLVELD, by this County Board of Lake County, Illinois, that the County Board Chairman is authorized to sign the attached intergovernmental Host Agreement and that the County Clerk shall certify said intergovernmental Host Agreement.
