R E S O L U T I O N
WHEREAS, Petite Lake Road, County Highway 51, from Fairfield Road, County Highway 49, to IL Rte. 83 is a designated route on the county highway system; and
WHEREAS, it would be beneficial to the safety and welfare of the motoring public if Petite Lake Road from Fairfield Road to IL Rte. 83 could be improved by widening and reconstruction and including its realignment at its intersection of IL Rte. 83 northerly of its present location and including provision for the detention of stormwater; and
WHEREAS, Lake County, by and through its Division of Transportation, has caused to be prepared a plat of survey of proposed centerline for Petite Lake Road from Fairfield Road to IL Rte. 83 for said widening and reconstruction and realignment at its intersection with IL Rte. 83 northerly of its present location, said plats of survey of proposed centerline identifying right-of-way needs; and
WHEREAS, said plats of survey of proposed centerline was recorded as document 5886075 on October 31, 2005; and
WHEREAS, this Lake County Board, at its meeting of March 14, 2006, approved a resolution authorizing, empowering, and directing the States Attorney of Lake County to institute proceedings in a court of competent jurisdiction to acquire title to and possession of said property for Lake County in accordance with the Eminent Domain Laws in the State of Illinois; and
WHEREAS, this Lake County Board, by prior resolution at its meeting of March 14, 2006, appropriated $750,000 of Motor Fuel Tax funds for the acquisition of necessary right-of-way and stormwater detention site by agreement or condemnation, and other right-of-way costs associated with the proposed widening and construction of Petite Lake Road; and
WHEREAS, this Lake County Board, by prior resolution at its meeting of March 11, 2008, appropriated a supplemental amount of $1,450,000 of Motor Fuel Tax funds for the acquisition of necessary right-of-way and stormwater detention site and other right-of-way costs associated with the proposed widening and construction of Petite Lake Road; and
WHEREAS, this Lake County Board, by prior resolution at its meeting of July 8, 2008, appropriated a supplemental amount of $300,000 of Motor Fuel Tax funds for the acquisition of necessary right-of-way and stormwater detention site and other right-of-way costs associated with the proposed widening and construction of Petite Lake Road; and
WHEREAS, the sum of the aforementioned amounts appropriated for the acquisition of necessary right-of-way and stormwater detention site and other right-of-way costs associated with the proposed widening and construction of Petite Lake Road is $2,500,000; and
WHEREAS, the cost of right-of-way and detention site, acquired or to be acquired, and other right-of-way acquisitions is now estimated to be $3,225,000.
NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that there is hereby appropriated a supplemental $725,000 of Motor Fuel Tax funds for the purchase of the real property determined to be necessary in the parcel plats of survey for Petite Lake Road from Fairfield Road to IL Rte. 83 for said widening and reconstruction and including its realignment at its intersection of IL Rte. 83 northerly of its present location and including the detention site, and designated as Section 00-00181-03-RS.
BE IT FURTHER RESOLVED that this supplemental appropriation be processed by the County Engineer for final approval of the Illinois Department of Transportation in accordance with the "Agreement of Understanding" between the Illinois Department of Transportation and Lake County, dated January 22, 2003.
