· The North Shore Bike Path will be improved with the construction of a bicycle crossing with pedestrian gates, at the Union Pacific Railroad Crossing (UPRR) at Illinois Route 176 in Lake Bluff.
· This improvement will also require the UPRR to perform work at the railroad crossing at an estimated cost of $324,133.
· Lake County will reimburse the UPRR for the cost of this work.
· Lake County day labor will construct the realigned bike path approaches to the railroad crossing, at an estimated material cost of $32,580.
· This resolution authorizes an agreement with the UPRR for their portion of the work, and appropriates $430,000 of Matching Tax funds for the construction and construction material costs.

R E S O L U T I O N
WHEREAS, Lake County owns and maintains the North Shore Bike Path on the County bike path system; and
WHEREAS, it would be beneficial to the safety and welfare of the motoring public if a bicycle crossing, with pedestrian gates, could be constructed at the UPRR Crossing at Illinois Route 176 in Lake Bluff; and
WHEREAS, this improvement will also require the UPRR to perform work at the railroad crossing at an estimated cost of $324,133; and
WHEREAS, Lake County will reimburse the UPRR for the cost of this work; and
WHEREAS, Lake County day labor will construct the realigned bike path approaches to the railroad crossing at an estimated material cost of $32,580; and
WHEREAS, Lake County and the UPRR are desirous of entering into an agreement stating the current terms and conditions by which Lake County will reimburse the UPRR for said construction work, a draft copy of which is attached hereto.
NOW, THEREFORE BE IT RESOLVED that the County Board Chair, the County Clerk, and the County Engineer of Lake County, Illinois, are authorized and they are hereby directed to execute an agreement and any subsequent amendments, between Lake County and the UPRR, stating the terms and conditions by which Lake County will reimburse the UPRR for the construction of the North Shore Bike Path improvement in consideration of the estimated sum of $324,133.
BE IT FURTHER RESOLVED that the County Engineer shall transmit, in writing, the final agreement and any amendments to be executed by the County Board Chair and the County Clerk.
BE IT FURTHER RESOLVED that there is hereby appropriated $430,000 of Matching Tax funds for these construction and construction material costs, and designated as Section 10-00252-02-BT.
