Resolution to vacate an unimproved portion of a right-of-way located east of Lawson Road in the Fox River Springs Subdivision in Antioch Township.

 

Staff Summary

                     Margarita Castro and Timothy T. Bond and Kimberly Bond, record owners, are requesting the vacation of an unimproved right-of-way located east of Lawson Road and adjacent to 42657 N Park Avenue and 42647 N Forest Lane, in Antioch, Illinois. The proposed right-of-way sought to be vacated is approximately 42.5 feet wide, extending approximately 125.94 feet east, and consists of approximately 0.12 acres.

                     The right-of-way has not been improved nor accepted by the Antioch Township Highway Commissioner. The Highway Commissioner requested an easement for an existing stormwater management system which has been provided by the applicant and therefore has no objections to the proposed vacation. No objection was received from public utility companies.

                     The Board of Vacations held a public hearing on April 16, 2025, which was continued to June 3, 2025, and concluded on July 23, 2025, and recommended unanimously to grant the vacation. Following a recommendation by the Planning, Building, Zoning and Environment Committee, the vacation request will proceed to the County Board for final action.

RESOLUTION

 

WHEREAS, on April 16, 2025, June 3, 2025, and July 23, 2025, public hearings were held before the Board of Vacations pursuant to Section 151.204 of the Lake County, Illinois Code of Ordinances, as amended, on the petition of Margarita Castro and Timothy T. Bond and Kimberly Bond, record owners, requesting a vacation of an unimproved right-of-way located east of Lawson Road, approximately 42.5 feet wide, that extends approximately 125.94 feet east, and consists of approximately 0.12 acres, located in the Fox River Springs Subdivision, Antioch, Illinois, and more fully described as follows:

 

That part of Lawson Street in Fox River Springs, being a subdivision in part of the Northeast ¼ of Section 9 and part of the West ½ of Section 10, Township 48 North, Range 9 East of the Third Principal Meridian, according to the plat hereof recorded September 30, 1914 as Document 155456, in Book “J” of Plats, pages 14 and 15, described as follows: Beginning at the Northwest corner of Lot 18 in Block 6 of said Fox River Springs, thence Northwesterly, on a Northwesterly continuation of the Westerly line of said Lot 18, to the Southerly line of Lot 15 in Block 3 of said Fox River Springs, thence Easterly along the Southerly line of said lot 15 to the shoreline of the Fox River; thence Southerly along the shoreline of the Fox River to the Northerly line of said Lot 18; thence Westerly along the Northerly line of said Lot 18 to the place of beginning, all in Lake County, Illinois; and

 

WHEREAS, the petitioners are the owners of the following parcels of real estate, to-wit:

 

Lot 15 in Block 3 in Fox River Springs, being a Subdivision in part of the Northeast ¼ of Section 9 and part of the West ½ of Section 10, Township 46 North, Range 9, East of the Third Principal Meridian, according to the Plat thereof recorded September 30, 1914 as Document 155456, in Book “J” of Plats, pages 14 and 15, in Lake County, Illinois (PIN 01-10-102-015)

 

And

 

Lot 18 in Block 6 in Fox River Springs, being a Subdivision in part of the Northeast ¼ of Section 9 and part of the West ½ of Section 10, Township 46 North, Range 9, East of the Third Principal Meridian, according to the Plat thereof recorded September 30, 1914 as Document 155456, in Book “J” of Plats, pages 14 and 15, in Lake County, Illinois (PIN 01-10-105-001); and

 

WHEREAS, after reviewing the testimony presented at the aforementioned public hearing of the Board of Vacations, said Board has submitted its recommendation and report to the Planning, Building, Zoning and Environment Committee; and

 

WHEREAS, the Board of Vacations recommends approval of the vacation request based on the finding that a vacation of the subject portion of Lawson Road, with a 15-foot utility easement for existing infrastructure, will have no negative impact on the general public or public infrastructure.

 

NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the public right-of-way, as described above, is hereby vacated and that portion of said plats of subdivision are hereby revoked, annulled, and set aside; and

 

BE IT FURTHER RESOLVED, that this resolution shall take effect and be in force for and after its passage provided that said petitioners shall after the passage of this resolution, file for recording in the office of the Recording Division of the Lake County Clerk’s Office, a certified copy of this resolution, the application, and the Deed of Vacation.
