Joint  resolution authorizing the transfer of approximately 0.04 acres of real estate and 0.2 acres of temporary construction easement for highway purposes at no cost located in the southeast quadrant of the intersection of Wilson Road and Rollins Road from Lake County to Grant Township Road District.

                     Grant Township Road District: ROW Transfer

                     The Grant Township Road District desires to improve Oak Lane where it makes a 90 degree jogged turn adjacent to County owned right-of-way.

                     The amount of property needed for the improvement is approximately .04 acres of fee simple and 0.2 acres for a construction easement.

                     The transfer is made at no cost, as provided by the Illinois Local Government Property Transfer Act.

R E S O L U T I O N

 

WHEREAS, Lake County is the owner of certain real estate located in the southeast quadrant of, and in proximity to, the intersection of Wilson Road (County Highway 7) and Rollins Road (County Highway 31); and,

 

WHEREAS, the Grant Township Road District has approved an Ordinance, a draft copy of which is attached hereto as Exhibit B, declaring that it is necessary and convenient for it to acquire certain property owned by the County of Lake; and,

 

                     WHEREAS, the Public Works and Transportation Committee has determined that the best interest of Lake County would be served by dedicating a certain portion of said real estate, hereinafter the DEDICATION, to the Grant Township Road District, hereinafter the ROAD DISTRICT, for public road purposes, to construct an improvement on Oak Lane to facilitate the free flow of traffic and ensure the safety of the motoring public; and,

 

                     WHEREAS, the construction of said improvement will require a temporary construction easement, hereinafter the EASEMENT, on said Lake County owned real estate.  Said DEDICATION and said EASEMENT are depicted and legally described on EXHIBIT A attached hereto; and,

 

                     WHEREAS, pursuant to the Local Government Property Transfer Act, 50 ILCS 605/4, the County may transfer all of its right, title, interest in the said County owned property, or portions thereof, to the ROAD DISTRICT upon such terms as may be agreed upon by the corporate authorities of the County and the ROAD DISTRICT and subject to the provision of such act; and

 

                     WHEREAS, pursuant to the 50 ILCS 650/2 the County Board may authorize its County Board Chair to convey real estate belonging to it; and,

 

NOW, THEREFORE BE IT RESOLVED BY this County Board of Lake County, Illinois, that the Chair of the County Board, the County Clerk, and the County Engineer on behalf of Lake County be authorized and they are hereby directed to execute whatever documents are necessary to effect such conveyance and transfer to the ROAD DISTRICT, at no cost to the ROAD DISTRICT, of the real estate depicted and described on EXHIBIT A attached hereto titled PLAT OF DEDICATION TO GRANT TOWNSHIP ROAD DISTRICT FOR PUBLIC ROAD PURPOSES.
