Joint resolution authorizing an agreement for retail water supply services to the Old School Road Service Area with the Village of Mettawa.
Staff Summary
· The Central Lake County Joint Action Water Agency (CLCJAWA) previously authorized the County to provide water to the Village of Mettawa through the County's Knollwood/Rondout water system.
· The County and Village of Mettawa previously approved a retail water agreement in 2012 to serve eight properties along St. Mary's Road.
· The Village has requested that an additional 34 properties within the Old School Road Service Area be added for retail water service.
· The Village proposes to utilize a combination of developer contributions and formation of a Special Service Area (SSA) to fund the water system improvements and will design and construct the water system extension to County specifications, for subsequent ownership and operation by the County.
· This agreement is being approved concurrently with approval of an Intergovernmental Agreement for Contract Police Services between the Village of Mettawa, the County, and the Lake County Sheriff.
· This resolution authorizes the execution of an Agreement for Retail Water Supply Services to the Mettawa Old School Road Service Area between the County and the Village and establishes the rights and responsibilities of the parties regarding the SSA and the design, construction, ownership and operation of the water system.

R E S O L U T I O N
WHEREAS, the County of Lake (County) owns and operates the Knollwood water system, which serves areas of unincorporated Lake County as well as portions of the Village of Mettawa (Village); and
WHEREAS, the Village has proposed the establishment of a Special Service Area (SSA) to extend the Knollwood water distribution system to provide water to up to thirty four (34) residential properties in the Old School Road Service Areas utilizing water from the Central Lake County Joint Action Water Agency as the source; and
WHEREAS, the Village has agreed to cause the design, construction, installation, and dedication of the water distribution system to the County using proceeds from developer contributions and SSA funding; and
WHEREAS, the County and the Village wish to enter into an Agreement for Retail Water Supply Services to Mettawa Old School Road Service Area to establish the terms, rights and responsibilities by which the project will be administered; and
WHEREAS, execution of an Agreement for Retail Water Service must be authorized by Resolution of this County Board; and
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois that the Chair of the County Board and the Clerk of said County be and are hereby authorized and directed to execute the Agreement for Retail Water Supply Services to Mettawa for Old School Road Service Area with the Village of Mettawa in substantially the form attached and subject to the Village's approval of the SSA Establishing Ordinance and this Retail Water Agreement.
