• The Village of Mundelein will be responsible for all capital and routine maintenance and will have permit authority of Hawley Street from North Lake Street (United States Route 45) easterly to Illinois Route 176.
• The Village has an improvement planned for this section of Hawley Street, that will improve the road and complete a non-motorized gap between the North Shore Path and Millennium Trail.
• The Village of Mundelein approved this agreement on April 14, 2025.

RESOLUTION
WHEREAS, Hawley Street, County Highway 70, is a designated route on the county highway system from Illinois Route 176 easterly to the east edge of pavement of Seymour Avenue, and a municipal extension from the east edge of pavement of Seymour Avenue easterly to Illinois Route 176; and
WHEREAS, Lake County and the Village of Mundelein are desirous for Hawley Street, from the east edge of pavement of North Lake Street (United States Route 45) easterly to Illinois Route 176 be under Village jurisdiction; and
WHEREAS, pursuant to 605 ILCS 5/5-105, the County Board of Lake County, Illinois by resolution, may transfer road jurisdiction to another highway authority upon the approval of the Illinois Department of Transportation (IDOT); and
WHEREAS, this County Board of Lake County, Illinois, may, by resolution approved by IDOT, remove the municipal extension of County Highway 70 designation from Hawley Street, from the east edge of pavement of Seymour Avenue easterly to Illinois Route 176, in accordance with the provisions of 605 ILCS 5/5-106; and
WHEREAS, with this jurisdictional transfer, which shall be effective upon the IDOT’s approval, Lake County is deleting the portion of Hawley Street, from the east edge of pavement of North Lake Street (United States Route 45) easterly 0.07 miles to the east edge of pavement of Seymour Avenue, from the Lake County Highway System; and
WHEREAS, with this jurisdictional transfer, which shall be effective upon the IDOT’s approval, Lake County is deleting the municipal extension portion of Hawley Street, from the east edge of pavement of Seymour Avenue easterly 0.78 miles to Illinois Route 176, from the Lake County Highway System; and
WHEREAS, the Village of Mundelein will be responsible for all capital and routine maintenance of Hawley Street from the east edge of pavement of North Lake Street (United States Route 45) to Illinois Route 176; and
WHEREAS, this agreement also authorizes permitting authority to the Village of Mundelein for Hawley Street from the east edge of pavement of North Lake Street (United States Route 45) to Illinois Route 176; and
WHEREAS, the Village of Mundelein approved this agreement on April 14, 2025.
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that Hawley Street from the east edge of pavement of North Lake Street (United States Route 45) easterly to the east edge of pavement of Seymour Avenue in its entirety will be deleted from the County Highway System of Lake County, in accordance with the applicable provisions of the Illinois Highway Code and as approved by the Illinois Department of Transportation; and
BE IT FURTHER RESOLVED, that the municipal extension of County Highway 70 designation of Hawley Street be removed, from the east edge of pavement of Seymour Avenue easterly to Illinois Route 176, as depicted on the map in Exhibit A; and
BE IT FURTHER RESOLVED, that the County Board Chair, the County Clerk, and the County Engineer of Lake County, Illinois, be authorized and they are hereby directed to execute this agreement and any subsequent amendments; and
BE IT FURTHER RESOLVED, that the County Engineer shall transmit in writing the final Agreement for the jurisdictional transfer to be executed by the County Board Chair and the County Clerk; and
BE IT FURTHER RESOLVED, that a copy of this agreement for jurisdictional transfer, when executed in its final form, be submitted to the Illinois Department of Transportation for their approval and final processing; and
BE IT FURTHER RESOLVED, that the County Board Chair, the County Clerk and the County Engineer of Lake County are authorized and are hereby directed to prepare and transmit any information Illinois Department of Transportation determines is necessary to document the deletion from the County Highway System of Hawley Street from the east edge of pavement of North Lake Street (United States Route 45) easterly to Illinois Route 176 in its entirety in accordance with the provisions of 605 ILCS 5/4-409.
