Resolution to vacate an unimproved portion of Cherry Lane located in the Arthur T. McIntosh and Company’s Brigg’s Lake Subdivision in Ela Township.

 

Staff Summary

                     Thomas F. Naples and Deanna J. Naples, record owners, are requesting the vacation of an unimproved portion of Cherry Lane, adjacent to 23512 N Cedar Lane, in Lake Zurich, Illinois.

                     The proposed right-of-way sought to be vacated is approximately 33.3 feet wide, extending approximately 289.40 feet west, and consists of approximately 0.22 acres.

                     The right-of-way has not been improved nor accepted by the Ela Township Highway Commissioner. The Highway Commissioner has no objections to the proposed vacation.

                     ComEd requested a utility easement which has been provided by the applicant and therefore has no objections to the proposed vacation.

                     The Board of Vacations held a public hearing on October 1, 2025, and recommended granting the vacation unanimously, conditioned upon the inclusion of a utility easement on the plat.

                     Following a recommendation by the Planning, Building, Zoning and Environment Committee, the vacation request will proceed to the County Board for final action.

RESOLUTION

 

WHEREAS, on October 1, 2025, a public hearing was held before the Board of Vacations pursuant to Section 151.204 of the Lake County, Illinois Code of Ordinances, as amended, on the petition of Thomas F. Naples and Deanna J. Naples, record owners of 23512 N Cedar Lane, requesting a vacation of an unimproved portion  of Cherry Lane, approximately 33.3 feet wide, that extends approximately 289.40 feet west, and consists of approximately 0.22 acres, located in the Arthur T. McIntosh and Company’s Brigg’s Lake Subdivision, Lake Zurich, Illinois, and more fully described as follows:

 

That part of Cherry Lane lying south of and adjacent to the part of lot 9 in block 12 in Arthur T. McIntosh and Company’s Brigg’s Lake Subdivision of part of the northeast quarter of section 17, township 43 north, range 10, east of the third principal meridian, according to the plat thereof recorded June 6, 1936 as document 425346 in Book “X” of Plats, Pages 22 and 23, described as follows: Beginning at the southeast corner of said lot 9 and running thence west along the south line of said lot, 289.40 feet; thence north and parallel to the west line of said lot 33.00 feet; to the south line of said Cherry Lane also being the south line of Arthur T. McIntosh and Company’s Brigg’s Lake Subdivision; thence east along said south line 284.50 feet to the intersection with the southerly extension of easterly line of said lot 9; thence northerly along said extended southerly line, 33.33 feet to the point of beginning, in Lake County Illinois; and

 

WHEREAS, the petitioners are the owners of the following parcels of real estate, to-wit:

 

That part of Lot 9 in Block 12 in Arthur T. McIntosh and Company’s Brigg’s Lake Subdivision of part of the northeast ¼ of section 17, Township 43 north, Range 10, east of the third principal meridian, according to the plat thereof recorded June 6, 1936 as document 425346 in book “X” of plats, page 22 and 23 described as follows; beginning at the southeast corner of said lot and running thence west along the south line of said lot 289.40 feet; thence north and parallel to the west line of said lot, 59.50 feet; thence easterly 300.18 feet to a point of the east line of said lot which is 72.30 feet northerly of the southeast corner of said lot; thence southerly along the east line of said lot, 72.30 feet to the point of beginning, in Lake County, Illinois; and

 

WHEREAS, after reviewing the testimony presented at the aforementioned public hearing of the Board of Vacations, said Board has submitted its recommendation and report to the Planning, Building, Zoning and Environment Committee; and

 

WHEREAS, the Board of Vacations recommends approval of the vacation request based on the finding that a vacation of said subject portion of Cherry Lane is not currently being used by the public, and that its vacation, with the inclusion of a 10-foot utility easement for new infrastructure, will have no negative impact on the general public or public infrastructure.

 

NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the public right-of-way, as described above, is hereby vacated and that portion of said plats of subdivision are hereby revoked, annulled, and set aside; and

 

BE IT FURTHER RESOLVED, that this resolution shall take effect and be in force for and after its passage provided that said petitioners shall after the passage of this resolution, file for recording in the office of the Recording Division of the Lake County Clerk’s Office, a certified copy of this resolution, the application, and the Deed of Vacation.
