R E S O L U T I O N
WHEREAS, Lake County and the City of North Chicago did enter into an intergovernmental agreement approved July 21st, 2008 for the improvement of Martin Luther King Jr. Drive from IL Rte. 131 (Green Bay Road) to IL Rte. 137 (Sheridan Road) via federal funds administered by the Illinois Department of Transportation (IDOT) along with County and City funds and designated as Section 08-00124-09-PV; and
WHEREAS, said Lake County/North Chicago intergovernmental agreement provided for the County to assume the jurisdiction of segment of Martin Luther King Jr. Drive being improved as an addition to the IDOT designated County Highway System which system currently includes the segment of Martin Luther King Jr. Drive from IL Rte. 43 to IL Rte. 131 (County Highway 54); and
WHEREAS, IDOT has determined that the segment of Martin Luther King Jr. Drive from Lewis Avenue (County Highway 27) to IL Rte. 137 (Sheridan Road) is a municipal extension of County Highway 54 and in accordance with the provisions of 605 ILCS 5/5-106 and in accordance with the provisions of the said Lake County/North Chicago intergovernmental agreement, that segment of Martin Luther King Jr. Drive from Lewis Avenue to IL Rte. 137 will become a portion of the designated County Highway System of Lake County (County Highway 54); and
WHEREAS, IDOT has determined that the segment of Martin Luther King Jr. Drive from IL Rte. 131 (Green Bay Road) to Lewis Avenue is a municipal street of the City of North Chicago by virtue of a previous jurisdiction transfer from IDOT to the City of North Chicago and in accordance with the provisions of 605 ILCS 5/5-102 and other provisions of the Illinois Highway Code and in accordance with the provisions of the said Lake County/North Chicago intergovernmental agreement, that segment of Martin Luther King Jr. Drive from IL Rte. 131 to Lewis Avenue will become a portion of the designated County Highway System of Lake County (County Highway 54) upon IDOT approval of a separate jurisdiction transfer agreement between Lake County and the City of North Chicago; and
WHEREAS, the City of North Chicago and Lake County are desirous of entering into an agreement for the jurisdictional transfer from the City of North Chicago to Lake County of Martin Luther King Jr. Drive from IL Rte. 131 easterly to Lewis Avenue in its entirety to become part of County Highway 54 as generally depicted in the map attached as Supplement 1 to said agreement; and
WHEREAS, a draft copy of said agreement between the City of North Chicago and Lake County is attached hereto entitled as Local Agency Agreement for Jurisdictional Transfer.
NOW, THEREFORE BE IT RESOLVED by this County Board of Lake County that Martin Luther King Jr. Drive from IL Rte. 131 to IL Rte. 137 be added to the County Highway System of Lake County as County Highway 54 in accordance with the applicable provisions of the Illinois Highway Code and as approved by the Illinois Department of Transportation.
BE IT FURTHER RESOLVED, that the County Board does hereby reaffirm and if so deemed necessary by IDOT does hereby designate that portion of Martin Luther King Jr. Drive from Lewis Ave to IL Rte 137 as a municipal extension of County Highway 54 to be incorporated into the County Highway System as provided by law (605 ILCS 5/6-106) via the improvement of Section 08-00124-09-PV as referred to in this resolution.
BE IT FURTHER RESOLVED that the County Engineer of Lake County is authorized and is hereby directed to negotiate and prepare the final Local Agency Agreement for Jurisdictional Transfer of Martin Luther King Jr. Drive from IL Rte. 131 easterly to Lewis Avenue from the City of North Chicago to Lake County to become part of County Highway 54.
BE IT FURTHER RESOLVED that the County Clerk and the Chair of the Lake County Board be authorized and they are hereby directed to execute the final Local Agency Agreement for Jurisdictional Transfer. The County Engineer shall transmit in writing the final Local Agency Agreement for Jurisdictional Transfer to be executed by the Chair of the Lake County Board and the County Clerk.
BE IT FURTHER RESOLVED that a copy of this Local Agency Agreement for Jurisdictional Transfer, when executed in its final form, be submitted to Illinois Department of Transportation for their approval and final processing.
BE IT FURTHER RESOLVED that the County Clerk and the Chair of the Lake County Board and the County Engineer of Lake County are authorized and are hereby directed to prepare and transmit whatever information IDOT determines is necessary to document the addition to the County Highway System of Martin Luther King Jr. Drive from Lewis Avenue to IL Rte. 137 (Sheridan Road) in accordance with the provisions of 605 ILCS 5/5-106 and in accordance with the provisions of the said Lake County/North Chicago intergovernmental agreement.
