R E S O L U T I O N
WHEREAS, pursuant to authority granted by this Board of Lake County, the County Engineer heretofore called for sealed bids, by publication, for the widening and resurfacing of the intersection of Fairfield Road (County Highway 49) at Nippersink Road, including the installation of permanent traffic control signals and designated as Section 02-00150-02-TL; and
WHEREAS, pursuant to said publication calling for said bid, sealed bids were received and opened on October 27, 2009 at 10:00 a.m. at the Lake County Division of Transportation in Libertyville, Illinois; a tabulation of said bids being as follows:
Berger Excavating Contractors, Inc., Wauconda, Illinois $1,307,307.36
Glenbrook Exc. & Concrete, Inc., Wauconda, Illinois $1,359,363.85
Campanella & Sons, Inc., Wadsworth, Illinois $1,366,811.28
Lake County Grading Co., Libertyville, Illinois $1,397,397.00
Curran Contracting Co., Crystal Lake, Illinois $1,409,821.90
WHEREAS, the Public Works and Transportation Committee, the County Engineer and the Purchasing Agent have examined each bid, and it appears that the lowest responsible bidder is Berger Excavating Contractors, Inc., Wauconda, Illinois their bid being $1,307,307.36 based on estimated quantities and unit prices; and
WHEREAS, this County Board of Lake County, Illinois, by prior resolution at its meeting of June 16, 2009, appropriated $2,560,000 of Motor Fuel Tax funds for the improvement of the aforesaid section.
NOW, THEREFORE BE IT RESOLVED by this County Board of Lake County that a contract be awarded to said Berger Excavating Contractors, Inc., Wauconda, Illinois in accordance with their bid of $1,307,307.36 based on estimated quantities and unit prices and that the Purchasing Agent, the County Clerk, and the County Engineer of Lake County be authorized and they are hereby directed to enter into a contract with said low bidder for the widening and resurfacing of the intersection of Fairfield Road at Nippersink Road, including the installation of permanent traffic control signals and designated as Section 02-00150-02-TL.
BE IT FURTHER RESOLVED that in as much as such estimated quantities are the best approximation that can be determined at this time, these quantities may be added to, deducted from, or modified from in the final determination of the contract cost in accordance with Chapter 605 of the Illinois Compiled Statutes, Act 5, Section 5-205.2 without further Board action, providing the final cost chargeable to the funds appropriated does not exceed the appropriation.
BE IT FURTHER RESOLVED that there is hereby appropriated $1,390,000 of Matching Tax funds and $180,000 of Motor Fuel Tax funds for this improvement which acts to replace the previous Motor Fuel Tax fund appropriation of $2,560,000 for the same improvement designated as Section 02-00150-02-TL.
BE IT FURTHER RESOLVED that this award be processed by the County Engineer for final approval of the Illinois Department of Transportation in accordance with the “Agreement of Understanding” between the Illinois Department of Transportation and Lake County, dated January 22, 2003.
