Joint resolution appropriating $42,200 of ¼% Sales Tax funds for Transportation and Public Safety funds for right-of-way costs associated with the proposed improvements to the intersection of Wadsworth Road (County Highway 17) and IL Rte. 131 and designated as Section 03-00033-12-LA.

                     Wadsworth Road at IL Rte. 131, Intersection Improvement Right-of-way Action: Appropriation

                     Preliminary plans and specifications have been prepared for improvements to the intersection of Wadsworth Road at Cambridge Drive.  It is a new subdivision road.

                     A developer donation ($979,100) has been accepted for the Cambridge Drive site access work.

                     By prior major access permit, Cambridge Homes, D.R. Horton, was required to provide a cash donation to guarantee that they would acquire the necessary right-of-way for their portion of the improvement.

                     Once the developer’s acquisitions were complete a portion of the cash contribution was to be reimbursed by Lake County.

                     Cambridge Homes, D.R. Horton, has completed its right-of-way acquisition and has submitted a request for reimbursement of a portion of their cash donation for said acquisition ($42,200).

                     Before this refund can be processed an appropriation of $42,200 of ¼% Sales Tax for Transportation and Public Safety funds is necessary.

R E S O L U T I O N

                     WHEREAS, Wadsworth Road (County Highway 17) is a designated route on the county highway system; and 

 

                     WHEREAS, it would be beneficial to the safety and welfare of the motoring public if the intersections of Wadsworth Road at IL Rte. 131 and Wadsworth Road at Cambridge Boulevard could be improved by widening, reconstruction and the modernization of traffic control signals; and

 

                     WHEREAS, Cambridge Homes, D.R. Horton, was issued an access permit for their new subdivision road, Cambridge Boulevard, and the construction of their required site access work was made a part of the county’s ongoing improvement to the intersection of Wadsworth Road at IL Rt. 131; and

 

                     WHEREAS, the terms and conditions of said access permit required Cambridge Homes, D.R. Horton to acquire portions of right-of-way necessary for said future access work; and

 

                     WHEREAS,                     a cash donation in the amount of $979,100 was accepted from Cambridge Homes, D.R. Horton for said future access work, a portion of which amount was for the cost of required right-of-way, in case said Cambridge Homes, D.R. Horton did not so acquire it; and

 

                     WHEREAS, Cambridge Homes, D.R. Horton, has now completed said right-of-way acquisitions and has submitted a request for reimbursement of a portion of its cash donation therefore in the amount of $42,200.

 

                     NOW, THEREFORE BE IT RESOLVED by this County Board of Lake County, Illinois, that there is hereby appropriated $42,200 of ¼% Sales Tax for Transportation and Public Safety funds to reimburse the Cambridge Homes, D.R. Horton, for its acquisition of necessary right-of-way for the improvements to the intersection of Wadsworth Road at IL Rte. 131 and designated by Section 03-00033-12-LA.

 

                     BE IT FURTHER RESOLVED that the County Engineer process said reimbursement and that the County Treasurer is hereby directed to pay said amount.
