· In accordance with Public Act 097-0673 regarding 55 ILCS 5/4-2002(c), the State's Attorney's Office began to charge a $2 fee paid by the defendant on a judgment of guilty or a grant of supervision for a violation of any provision of the Illinois Vehicle Code or any felony, misdemeanor, or petty offense to discharge the expenses of the State's Attorney's office.
· Per State statute, these funds must be deposited into a special fund designated as the State's Attorney Records Automation Fund for the specified purposes of hardware, software, research, and development costs and personnel related to establishing and maintaining automated record keeping systems.
· Unfortunately, a segregated Special Revenue Fund was not established at the time the fee was enacted. Therefore, the funds that have been collected, totaling $145,417.76 since June 2012, have fallen into General Fund fund balance.
· This resolution establishes the State's Attorney's Automation Fund, transfers collected funds from the General Fund to this new fund, and transfers the FY2015 budget from the State's Attorney's General Fund budget to the new fund.

RESOLUTION
WHEREAS, Public Act 097-0673 regarding 55 ILCS 5/4-2002(c) allows for the imposition of a fee to discharge the expenses of the State's Attorney's office for establishing and maintaining automated record keeping systems ; and
WHEREAS, Lake County began to collect this fee in June 2012 with the revenue being deposited into a unique account specifically for this revenue stream in the General Fund; and
WHEREAS, this revenue and allowable expenditures including hardware, software, research, and development costs and personnel related to automated record keeping systems, should be accounted for in a unique special revenue fund, namely the State's Attorney's Records Automation Fund, according to 55 ILCS 5/4-2002(c); and
WHEREAS, it is necessary to establish a special revenue fund and to transfer the collected revenue amount of $145,417.76 from the General Fund to this new fund, and to move the adopted FY2015 budget from the State's Attorney's Office General Fund budget to the new fund through a line item transfer.
NOW, THEREFORE, BE IT RESOLVED, by this Lake County Board, that a new fund, namely the State's Attorney's Records Automation Fund, will be developed and collected revenues that have fallen into General Fund reserves in the amount of $145,417.76 will be transferred to this fund.
BE IT FURTHER RESOLVED, that a line item transfer in the amount of $55,100 will be conducted from 101-3300010-46255 to 263-3370010-46255 and from 101-3300010-79920 to 263-3370010-79920 in the amount of $20,100 to transfer previously approved FY2015 budget authority to the new fund.
