Staff Summary
·      Subject property is a vacant 0.9 acre parcel located on the south side of Grass Lake Road 1.2 miles east of the Fox River Bridge in Antioch Township.
·      Applicants have no specific plans for the use of the property although it abuts commercial zoning and uses to the west.
·      Property may be purchased by the owner of the west adjoining auto repair business (but it cannot be used as part of this business without a conditional use permit).
·      Although the property is wooded, it is not a protected woodland due to its size and tree species.
·      Property is shown as Agricultural on County's comprehensive plan; sewer and water are not available.
·      ZBA recommends approval (5-1); Planning Department staff recommends denial.  See attached reports for further explanation.
·      The Planning, Building and Zoning Committee recommends approval (3 - 2).

WHEREAS, a public hearing has been held by the Lake County Zoning Board of Appeals pursuant to the Statutes of the State of Illinois on the petition of Mason Aron, record owner, relative to a request for rezoning from the Agricultural Zone to the General Commercial zone for the following real estate, to-wit:
 
A TRACT OF LAND DESCRIBED AS BEGINNING AT SOUTHEAST CORNER OF THE WEST THREE QUARTERS OF THE SOUTH HALF OPTHE SOUTHEAST QUARTER OF FRACTIONAL SECTION 26, TOWNSHIP 46 NORTH,  RANGE 9 EAST OF THE THIRD PRINCIPAL MERIDIAN; THENCE WESTERLY ALONG SAID SOUTH LINE OF SAID FRACTIONAL SECTION 26, A DISTANCE OF LINE 642.14 FEET TO THE POINT OF BEGINNING OF THE PARCEL INTENDED TO BE DESCRIBED; THENCE CONTINUING WESTERLY ALONG THE SAID SOUTH LINE OF SAID FRACTIONAL SECTION 26, A DISTANCE OF 217.24 FEET; THENCE NORTHEASTERLY ALONG A LINE MAKING AN ANGLE OF 104 DEGREES 52 MINUTES TO THE RIGHT FROM THE LAST DESCRIBED LINE PRODUCED WESTERLY, 160 FEET. MORE OR LESS TO THE SOUTH RIGHT OF WAY LINE OF GRASS LAKE ROAD (STATE AID ROUTE NO. 16); THENCE NORTHEASTERLY ALONG SAID RIGHT OF WAY LINE OF A CURVE TO THE LEFT HAVING A RADIUS OF 1045.2 FEET, AN ARC DISTANCE OF 182.40 FEET, SAID ARC HAVING A CHORD BEARING OF NORTH 66 DEGREES 55 MINUTES 09 SECONDS EAST AND A LENGTH OF 182.17 FEET; THENCE, LEAVING THE RIGHT OF WAY LINE OF GRASS LAKE ROAD, SOUTH 00 DEGREES 32 MINUTES 02 SECONDS EAST, PARALLEL WITH THE. EAST LINE OF THE WEST THREE QUARTER OF THE SOUTH HALF TO THE SOUTHEAST QUARTER OF SAID FRACTIONAL SECTION 26, 254.52 FEET TO THE POINT OF BEGINNING, IN LAKE COUNTY, ILLINOIS.

WHEREAS, your Department of Planning, Building and Development duly considered the aforesaid petition and recommends that it be denied; and
 
WHEREAS, your Zoning Board of Appeals, after reviewing the testimony presented at the public hearing on the aforesaid petition, has submitted its report thereon to the County Board and its report recommends by a vote of 5 - 1 that the petition be granted; and
 
WHEREAS, your Planning, Building and Zoning Committee duly considered the petition and reports aforedescribed and recommends by a vote of 3 - 2 that the petition be granted.
 
 
NOW, THEREFORE, BE IT RESOLVED by the Lake County Board, that the prayer of the Petitioner be granted and that the above described real estate shall be rezoned from the Agricultural zone to the General Commercial zone; and
 
BE IT FURTHER RESOLVED, that the Secretary of said Zoning Board of Appeals be instructed to notify the petitioner as to the action taken by the Board.
