(WCL), Canadian National Railroad (CN RR), Homewood, Illinois, for the reconstruction and maintenance of the roadway crossing for the intersection improvement of Rollins Road, at Illinois Route 83, and the grade separation of the WCL/CN RR, appropriating $3,300,0000 of ¼% Sales Tax for Transportation and Public Safety funds, and designated as Section 08-00080-56-BR.

· This resolution authorizes the execution of an agreement with WCL, and appropriates $3,300,000 of ¼% Sales Tax for Transportation and Public Safety funds.

R E S O L U T I O N
WHEREAS, Rollins Road, County Highway 31, is a designated route on the County highway system; and
WHEREAS, Lake County and the WCL believe it would be beneficial for the safety and welfare of the motoring public if Rollins Road, at its intersection Illinois Route 83, could be improved along with construction of a grade separation of the WCL/CN RR to provide increased traffic capacities (Rollins Road Gateway Improvement); and
WHEREAS, the Wisconsin Central Ltd., Homewood, Illinois, is the owner of the WCL/CN RR that crosses Rollins Road, at Illinois Route 83; and
WHEREAS, Lake County and the WCL are desirous of entering into an agreement providing the terms and conditions for the reconstruction and maintenance of the roadway crossing of Rollins Road, at the WCL/CN RR, a draft copy of which is attached hereto; and
WHEREAS, an appropriation of funds is required.
NOW, THEREFORE BE IT RESOLVED, that the County Board Chair, the County Clerk, and the County Engineer of Lake County, Illinois, are authorized and they are hereby directed to execute an agreement, and any subsequent amendments, between Lake County and the WCL, providing for the reconstruction and maintenance of the roadway crossing of Rollins Road, at the WCL/CN RR, and designated as Section 08-00080-56-BR.
BE IT FURTHER RESOLVED that the County Engineer shall transmit, in writing, the final agreement, and any amendments, to be executed by the Chair of the County Board and the County Clerk.
BE IT FURTHER RESOLVED that $3,300,000 of ¼% Sales Tax for Transportation and Public Safety funds is hereby appropriated, and designated as Section 08-00080-56-BR
