ORDINANCE FINDING IT NECESSARY OR CONVENIENT FOR LAKE COUNTY TO USE REAL ESTATE OWNED BY THE LAKE COUNTY FOREST PRESERVE DISTRICT IN CONNECTION WITH THE IMPROVEMENTS OF DEERFIELD ROAD, FROM ILLINOIS ROUTE 21/UNITED STATES ROUTE 45 TO SAUNDERS ROAD
WHEREAS, Deerfield Road, County Highway 11, is a designated route on the county highway system; and
WHEREAS, Lake County believes it would be beneficial to the safety and welfare of the traveling public if Deerfield Road, from Illinois Route 21/United States Route 45 to Saunders Road, could be improved with roadway improvements, non-motorized improvements, and intersection improvements; and
WHEREAS, this improvement requires the Lake County Forest Preserve District (District) to grant a temporary easement to allow the County to construct the improvements; and
WHEREAS, pursuant to Section 10 of Article 7 of the Illinois Constitution of 1970, units of local government, such as the County and the District, may contract or otherwise associate among themselves in any manner not prohibited by law or ordinance; and
WHEREAS, in accordance with the Local Government Property Transfer Act, 50 ILCS 605/0.01, et seq., it is necessary or convenient for the County to use, occupy, or improve the real estate, as depicted in the draft temporary easement agreement attached hereto, held by the District in the making of a public improvement or for a public purpose; and
WHEREAS, in accordance with the Local Government Property Transfer Act, 50 ILCS 605/0.01, et seq., the District may grant or convey such real estate to the County upon such terms as may be agreed upon by the corporate authorities of the County and the District and subject to the provisions of such Act; and
WHEREAS, the County and the District are desirous of entering into a temporary easement agreement stating the terms and conditions for the granting of temporary easements necessary to construct the improvements, a draft copy of the temporary easement agreement is attached hereto.
NOW, THEREFORE, BE IT ORDAINED, by this County Board of Lake County, Illinois, that the County Board Chair, the County Clerk, and the County Engineer of Lake County, Illinois, are authorized, and are hereby directed to enter into an agreement and any amendments, between Lake County and the Lake County Forest Preserve District stating the terms and conditions for the granting of a temporary easement necessary to construct the improvements of Deerfield Road, from Illinois Route 21/United States Route 45 to Saunders Road, designated as Section 15-00038-07-WR; and
BE IT FURTHER ORDAINED, that the County Engineer shall transmit, in writing, the final agreements and any amendments to be executed by the County Board Chair and the County Clerk; and
BE IT FURTHER ORDAINED, by this County Board of Lake County, Illinois, as follows:
Section 1: Recitals: The recitals set forth above are incorporated as part of this Ordinance by this reference.
Section 2: Declaration of Necessity: This County Board of Lake County, Illinois, hereby finds and declares that it is necessary, or convenient, for Lake County to use, occupy, or improve the real estate, held by the Lake County Forest Preserve District, as depicted and described in the draft temporary easement agreement, attached hereto, in the making of a public improvement or for a public purpose.
Section 3: Granting of the Easements: The County Engineer is hereby authorized to execute any documents that are necessary to accept and effectuate the granting of the above-described easements from the Lake County Forest Preserve District to Lake County in accordance with this Ordinance. The County Engineer shall prepare, or have prepared, the documents necessary for granting of the easements.
Section 4: This Ordinance shall be in full force and effect from, and after, its passage and adoption by this County Board of Lake County, Illinois.
