WHEREAS, York House Road, County Highway 65, is a designated route on the County highway system; and
WHEREAS, pursuant to 605 ILCS 5/5-105, the County Board, by resolution, may transfer road jurisdiction to another highway authority upon the approval of the Illinois Department of Transportation; and
WHEREAS, pursuant to 605 ILCS 5/5-410.1, the County Board, by the process established by law, may surrender jurisdiction over the right-of-way and improvements of all or part of a county highway, street or road to a municipality by agreement; and
WHEREAS, Lake County and the City of Waukegan are desirous of entering into an agreement for the jurisdictional transfer of the portion of York House Road, west limits eastward to Delany Road, approximately 6,550 feet in its entirety from Lake County to the City of Waukegan, as depicted in the draft of the agreement attached hereto; and
WHEREAS, with this jurisdictional transfer, which shall be effective upon Illinois Department of Transportation approval, Lake County is removing the portion of York House Road, County Highway 65, from its west limit eastward to Delany Road, County Highway 22, measuring approximately 6550 feet, from the Lake County Highway System.
NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that the County Board Chair, the County Clerk, and the County Engineer are hereby authorized and directed to process and execute any and all appropriate and related agreements with the City of Waukegan for said jurisdictional transfer agreement and as required by the Illinois Department of Transportation.
BE IT FURTHER RESOLVED that said jurisdictional transfer is effective upon the Illinois Department of Transportation approval.
