Title

Resolution authorizing a minor modification to the approved landscape plan for the Planned Unit Development (PUD) Final Plan for Scooter’s Restaurant Parking Lot and Alley Improvement Plan.

 

Staff Summary

                     The PUD Final Plan for Scooter’s Restaurant Parking Lot and Alley Improvement Plan was approved by the Committee on February 7, 2012.

                     With the exception of the completion of landscape improvements, the parking lot and related improvements are complete.

                     The developer, Jeffrey Glogovsky is seeking a minor modification to the approved PUD Final Plan reducing the amount of landscaping associated with the parking lot by 5 percent.

                     The basis for his request is his concern over the long-term viability of the plant material if spaced too close, and security in the area.

                     Staff has reviewed the proposed modification and is recommending approval of the modification along the west property line and in the parking island. We also have no objection to the change in plant species. The plan should remain unchanged along the north and east property lines to afford adequate buffering of the residential areas.

 

Body

WHEREAS, on February 7, 2012, the Planning, Building and Zoning Committee of the Lake County Board unanimously approved a resolution for a PUD Final Plan for a Conditional Use Permit for a Planned Unit Development entitled “Scooter’s Restaurant Parking Lot and Alley Improvement Plan;” and

 

WHEREAS, the approved plans for the PUD Final Plan included a landscape plan to buffer the adjacent properties, meet the landscaping standards contained in Article 9 of the Unified Development Ordinance, and to improve the aesthetics of the parking lot; and

 

WHEREAS, subsequent to the action on the PUD Final Plan, the applicant expressed concern the landscape plan approved with the PUD Final Plan contained excess plant material, and if installed, this excess material would negatively impact the long-term survival of the material if spaced too close together, and would create an unsafe condition for the area; and

 

WHEREAS, Article 3, Section 3.7.6 of the Unified Development Ordinance provides for minor modifications to approved PUD Final Plans when the applicant reduces the landscaping approved with the original plan 5 percent or less; and

 

WHEREAS, the applicant has provided an alternative landscape plan reducing the total plant material associated with the parking lot by 5 percent and has requested the proposed plan be utilized in completing the improvements for the parking lot; and

 

WHEREAS, Staff has assessed the proposed plan and has determined the plan fails to meet the intent of the original landscape plan along the north and east property lines and is opposed to a plant reduction in those areas. Staff is not opposed to the plant material reductions along the west property line or in the parking islands.  Additionally, staff is not opposed to the plant material species selected under the proposed plan and recommends approval of those elements of the plan.

 

NOW, THEREFORE, BE IT RESOLVED, by this Planning, Building and Zoning Committee of the Lake County Board, the requested minor modification to the approved landscape plan for the PUD Final Plan Scooter’s Restaurant Parking Lot and Alley Improvement Plan be approved subject to the conditions expressed in Exhibit “A”.
