Staff Summary

·      The 2009 Solid Waste Management Plan Update for Lake County, Illinois sets forth recommendations related to the development of transfer stations throughout the County.

·      Groot Industries desires to file with the Village of Round Lake Park a request for siting approval to construct and operate a transfer facility.  

·      An applicant proposing to site a transfer facility must enter into host agreements with Lake County, SWALCO and the Village.

·      Host agreements have been negotiated amongst all parties and the proposed agreement between Groot and Lake County is attached.

·      The host agreement stipulates various control measures that Groot must adhere to in order to minimize the impact to the surrounding areas, as well as a fee paid to the County.  

·      The host agreement will be in effect until the transfer facility ceases to operate, with Groot agreeing to exercise all commercially reasonable efforts to operate the transfer facility for a minimum of twenty years.

RESOLUTION

ADOPTING A HOST AGREEMENT BETWEEN GROOT INDUSTRIES, INC. AND LAKE COUNTY, ILLINOIS

WHEREAS, Lake County, Illinois is a public body and corporate; and

WHEREAS, Groot Industries, Inc. ("Company") is an Illinois corporation that desires to file with the Village of Round Lake Park, Illinois a request for siting approval to construct and operate a transfer facility; and

WHEREAS, The 2009 Solid Waste Management Plan Update for Lake County, Illinois sets forth recommendations related to the development of transfer stations throughout the County.

WHEREAS, an applicant proposing to site a transfer facility must enter into host agreements with Lake County, SWALCO and the Village; and

WHEREAS, the attached intergovernmental Host Agreement would fulfill this requirement; and

WHEREAS, the Company desires to provide certain benefits to Lake County with respect to the transfer facility if the transfer facility obtains all required approvals and satisfies all conditions provided for in the Host Agreement; and

WHEREAS, if the Village of Round Lake Park grants siting approval for the Transfer Facility, the Illinois Environmental Protection Agency issues appropriate and necessary permits for the development and operation of the Transfer Facility on the Subject Property, and the Transfer Facility is constructed, commences operations and receives waste, then the Company is willing to afford certain benefits as set forth in the Host Agreement to Lake County; and

NOW THEREFORE BE IT RESOLVED, by this County Board of Lake County, Illinois, that the Chairman of the County Board be hereby authorized and directed to execute the Host Agreement between Groot Industries, Inc., an Illinois Corporation and Lake County, Illinois in substantially the attached form, with such final revisions as may be necessary.
