R E S O L U T I O N
 
WHEREAS, Deerfield Rd. (County Highway 11) is a designated route on the county highway system; and
 
WHEREAS, the American Recovery and Reinvestment Act of 2009 (ARRA), i.e. the federal stimulus bill, allocated additional dollars to the State of Illinois under the Surface Transportation Enhancement Program (STP/E), which funds must be authorized by March 3, 2010; and
 
WHEREAS, the Lake County Division of Transportation has had underway, thru the IDOT federal project approval process, the segment of the Deerfield Rd. Bike Path along the southside of Deerfield Rd. from Thornmeadow Rd. westward across the Des Plaines River to connect with the existing Lake County Forest Preserve District Des Plaines River Trail; and
 
WHEREAS, IDOT has chosen the County's said segment of the Deerfield Rd. Bike Path for said ARRA STP/E fund for eighty percent of the construction cost (maximum federal amount of $1,166,800).
 
      WHEREAS, the State of Illinois and Lake County are desirous on entering into an agreement for the use of said federal highway funds for this improvement, a draft copy of which is attached hereto.
 
      NOW, THEREFORE BE IT RESOLVED by this County Board of Lake County, Illinois, that the Chair of the County Board, the County Clerk, and the County Engineer of Lake County are authorized and they are directed to execute an agreement pertaining to the financing of the above-named improvement.  The County Engineer shall transmit, in writing, the final agreement to be executed by the Chair of the County Board and the County Clerk and grant plan and specification approval to the Illinois Department of Transportation.
 
      BE IT FURTHER RESOLVED that there is hereby appropriated $595,000 of County Bridge Tax funds for this improvement designated as Section 04-00038-03-BT.
 
      BE IT FURTHER RESOLVED that a copy of this agreement, when executed in its final form, be submitted to the Illinois Department of Transportation for their approval and final processing.
 
      BE IT FURTHER RESOLVED that this agreement be administered in accordance with Chapter 605, Act 5, section 5-205.2 of the Illinois Compiled Statutes without further Board action providing the final contract cost chargeable under the fund appropriated does not exceed the appropriations provided.
