Ordinance amending Lake County Code of Ordinances Chapter 171: Onsite Wastewater Treatment Systems (OWTS).
Staff Summary
• Revisions are proposed to multiple sections of Chapter 171 for clarity, precision and consistency based on experience enforcing the provisions. These revisions include:
o changes to certain definitions or provisions
o changes or replacement of technical terms
o changes to certain provisions to align with the Illinois Department of Public Health Private Sewage Disposal Code
• There are significant revisions to the sections that contain provisions for:
o the revocation of OWTS contractor licenses and OWTS site plan approval
o the suspension of OWTS construction approval
o the hearing process that applies in these instances
• The revisions provide for greater clarity of these processes and stipulate that hearings for these matters shall be held before the Lake County Board of Health Hearings Committee in accordance with Lake County Code of Ordinances Chapter 176, rather than with the Health Officer.

ORDINANCE
WHEREAS, the Lake County Health Department is authorized to enforce a local ordinance regulating onsite wastewater treatment systems to protect the public’s health and safety; and
WHEREAS, the Lake County Board incorporated the Lake County Onsite Wastewater Treatment Systems Ordinance into the Lake County Code of Ordinances at Chapter 171 on November 12, 2013; and
WHEREAS, the Lake County Health Department is proposing amendments to this Chapter for clarity, precision and consistency, and to further establish and stipulate requirements for the revocation of OWTS contractor licenses and OWTS site plan approval, the suspension of OWTS construction approval, and the hearing process that applies in these instances; and
WHEREAS, the Lake County Board of Health has approved the proposed amendments to Chapter 171 on June 26, 2024; and
WHEREAS, the Lake County Board of Health has recommended that the proposed amendments to Chapter 171 be referred to the County Board for approval.
NOW, THEREFORE, BE IT ORDAINED, by this County Board of Lake County, Illinois, that the amendments to Lake County Code of Ordinances Chapter 171 herewith be approved and made a matter of Lake County law; and
BE IT FURTHER ORDAINED, that the Lake County Clerk is hereby authorized to distribute certified copies of the amended Ordinance to the County Administrator, Comptroller, and the Executive Director of the Lake County Health Department.
