Joint resolution authorizing an emergency appropriation and acceptance of a grant award for $9,130 for the Tobacco Enforcement program from the State of Illinois Liquor Control.

 

Staff Summary

                     This is the annual Tobacco Enforcement Grant which covers the time period of July 1, 2010 through June 30, 2011.

                     The grant funds all expenses related to this enforcement including 144 hours of officer overtime at $55.97 per hour or $8,060 annually and $720 to pay minors to attempt to purchase tobacco for a total program cost of $8,780.

                     The three rounds of compliance checks resulted in 10 total violations with the fine potential of $200 per violation.

 

Body

                     WHEREAS, the State of Illinois Liquor Control Commission (Commission) has notified the Lake County Sheriff that a Tobacco Enforcement Grant had been awarded for the  time period August 1, 2010 through June 30, 2011; and

 

                     WHEREAS, the Lake County Sheriff will provide compliance checks with tobacco retailers; and

 

                     WHEREAS, the Commission will issue 50% of the contract amount upon execution of the contract and 50% upon receipt of the Tobacco Enforcement Summary for the 1st round of compliance checks. If after the first round of compliance checks the required number of checks was not completed, the Commission will provide written notice to the Lake County Sheriff indicating this action to pro-rate the agreement.

 

                     WHEREAS, the grant must be formally accepted by the County of Lake and the necessary appropriations and approvals made.

 

                     NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the acceptance of the Lake County Sheriff’s Tobacco Enforcement Grant in the amount of $9,130 for the period beginning August 1, 2010 through June 30, 2011; is hereby accepted; and

 

                     BE IT FURTHER RESOLVED, that the Chairman of the Board, the Lake County Sheriff, and the Lake County Treasurer are hereby authorized to execute the necessary documentation in order to accept the grant (grant program agreement to be attached hereto and hereby made a part of this Resolution); and

 

                     BE IT FURTHER RESOLVED, that an emergency appropriation for the grant in the amount of $9,130 is hereby authorized, as follows:

BE IT FURTHER RESOLVED, that offsetting revenue in the amount of $9,130 from the State of Illinois Liquor Control Commission will be deposited in the proper revenue account; and

 

BE IT FURTHER RESOLVED, that the Lake County Sheriff shall serve as project director for the program, and accurate records of all necessary grant compliance requirements shall be kept by the Lake County Sheriff’s Office.
