Joint resolution authorizing the execution of an intergovernmental agreement with the Village of Long Grove relating to delivery of water service to Herons Landing Subdivision.
Staff Summary
· Herons Landing is a 118 lot subdivision in the Village of Long Grove that is presently served by private wells.
· The subdivision Home Owners Association approached the Village and requested Lake Michigan water, and the County petitioned and received approval from the Central Lake County Joint Action Water Agency (CLCJAWA) to deliver water to Herons Landing through our Vernon Hills water system.
· The Village has established a Special Service Area (SSA) to fund the water system improvements and is proposing to convey the proceeds of the SSA bonds to the County. The County will design and construct the water system and subsequently own, operate and maintain the water system.
· The Village has passed a resolution approving and authorizing the execution of an intergovernmental agreement with the County relating to delivery of water service to the Herons Landing Subdivision subject to the County's approval.
· This resolution authorizes the execution of an intergovernmental agreement between the County and the Village that establishes the rights and responsibilities of the parties regarding the SSA and the design, construction, ownership and maintenance of the water system.

R E S O L U T I O N
WHEREAS, the County of Lake (County) owns and operates the water system for the Village of Vernon Hills, directly adjacent to the Herons Landing Subdivision in the Village of Long Grove (Village); and
WHEREAS, the Herons Landing Subdivision currently obtains water service from individual private shallow wells; and
WHEREAS, the Village has proposed the establishment of a Special Service Area (SSA) to construct a water distribution system to provide water to the Herons Landing Subdivision utilizing water from the Central Lake County Joint Action Water Agency as the source; and
WHEREAS, the Village has requested that the County design and construct the water distribution system using the proceeds of the SSA funds and subsequently own, operate and maintain the water system; and
WHEREAS, the County and the Village wish to enter into an Intergovernmental agreement to establish the terms, rights and responsibilities by which the project will be administered; and
WHEREAS, execution of an Intergovernmental Agreement must be authorized by Resolution of this County Board; and
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois that the Chair of the County Board and the Clerk of said County be and they are hereby authorized and directed to execute the Intergovernmental Agreement Relating to Delivery of Water Service to the Herons Landing Subdivision with the Village of Long Grove in substantially the form attached and subject to the Village's approval of the SSA Establishing Ordinance and this Intergovernmental Agreement.
