RESOLUTION
WHEREAS, pursuant to authority granted by this Lake County Board, the County Engineer heretofore called for sealed bids, by publication, for the intersection improvements of Darrell Road with Case Road and Neville Road, and is designated as Section 13-00107-09-CH; and
WHEREAS, pursuant to said publication and calling for said bids, sealed bids were received and opened March 14, 2023, at 10:00 a.m. at the Lake County Division of Transportation in Libertyville, Illinois; a tabulation of said bids being as follows:

WHEREAS, the Public Works and Transportation Committee, the County Engineer and the Purchasing Agent have examined each bid, and it appears that the lowest responsible bidder is Berger Excavating Contractors, their bid being $5,380,194.30 based on estimated quantities and unit prices; and
WHEREAS, the project requires a 110-day closure of the intersection in order to construct the improvements; and
WHEREAS, the contract includes an incentive to the contractor for opening the road early and a disincentive if the closure goes beyond the planned 110 days; and
WHEREAS, this Lake County Board, by prior resolution at its meeting of January 17, 2023, appropriated $8,100,000 of Motor Fuel Tax funds for the intersection improvement of Darrell Road with Case Road and Neville Road, which will be improved under the Illinois Highway Code for a total of 1.3 miles, and designated as Section 13-00107-09-CH.
NOW, THEREFORE, BE IT RESOLVED, by this Lake County Board, that a contract be awarded to said Berger Excavating Contractors, in accordance with their bid of $5,380,194.30, based on estimated quantities and unit prices, and that the Purchasing Agent, the County Clerk, and the County Engineer of Lake County be authorized and they are hereby directed to enter into a contract with said low bidder for the intersection improvement of Darrell Road with Case Road and Neville Road; which will be improved under the Illinois Highway Code for a total of 1.3 miles, and designated as Section 13-00107-09-CH.
BE IT FURTHER RESOLVED, that the County Engineer, for the processing of contract change orders, is hereby authorized and directed to treat the awarded base construction cost as the low bid amount of $5,380,194.30 plus any detour incentives up to a maximum of $75,000.
BE IT FURTHER RESOLVED, that in as much as such estimated quantities are the best approximation that can be determined at this time, these quantities may be added to, deducted from, or modified from in the final determination of the contract cost in accordance with Chapter 605 of the Illinois Compiled Statutes, Act 5, Section 5-205.2 without further Board action, providing the final cost chargeable to the funds appropriated does not exceed the appropriation.
BE IT FURTHER RESOLVED, that the Clerk is hereby directed to transmit four certified originals of this resolution to the district office of the Department of Transportation.
BE IT FURTHER RESOLVED, that this award be processed by the County Engineer for final approval of the Illinois Department of Transportation in accordance with the “Agreement of Understanding” between the Illinois Department of Transportation and Lake County, dated May 3, 2018.
