Staff Summary

                     Kyle Davis, on behalf of the Chicago Title Land Trust Company, Trustee under Trust Agreement #8002382433, record owner, has petitioned to rezone a 1.95 acre parcel from the Residential-3 (R-3) District to the General Commercial (GC) District. The property is located at 39660 N. Illinois Route 59, Lake Villa, Illinois (PIN 02-30-100-082).

                     The rezoning petition is partnered with an application for a Conditional Use Permit (CUP) for a Planned Unit Development (PUD) and Preliminary Development Plan. The property owner proposes to establish a 5,000 square foot office/storage building, and the associated parking and grading for contractor’s equipment storage building and future office space in the General Commercial (GC) zoning district.

                     The Zoning Board of Appeals (ZBA) recommended approval of the rezoning request by a vote of 6 “Ayes” and 1 “Nay” in conjunction with the recommendation of approval (with conditions) for the accompanying CUP-PUD Preliminary Development Plan (ZBA) Case No. 000803-2022.

RESOLUTION

 

WHEREAS, public hearings were held by the Lake County Zoning Board of Appeals on April 19 and May 10, 2023 pursuant to the Statutes of the State of Illinois on the petition of Chicago Title Land Trust Company, Trustee under Trust Agreement #8002382433, record owner, with Kyle Davis, of 617 Deerpath, Lindenhurst, Illinois, being the sole beneficiary of the trust, who seeks a rezoning of one parcel (PIN 02-30-100-082) totaling 1.95 acres from the Residential-3 (R-3) zoning district to the General Commercial (GC) zoning district for the following real estate, legally described as follows:

 

That part of the south half of the northwest quarter of Section 30, Township 46 North, Range 10, East of the Third Principal Meridian, Described as follows: Commencing at the intersection of the center line of State Route 59 and a line 135 south of and parallel with the north line of said south half of the northwest quarter; thence S 16 degrees, 00 minutes, 11 seconds W along said centerline, a distance of 213.95 feet to the point of beginning; thence continuing S 16 degrees, 00 minutes, 11 seconds W along said north line of the south half of the northwest quarter; thence S 89 degrees, 02 minutes, 19 seconds W along said, parallel line, a distance of 363.5’, thence N 16 degrees, 00 minutes, 11 seconds E, a distance of 276.75; thence S 89 degrees, 18 minutes, 31 seconds W, a distance of 363.0’ to the point of beginning, in Lake County, Illinois.

 

WHEREAS, your Department of Planning, Building and Development

duly considered the aforesaid petition and provided a staff report and recommendation to the Zoning Board of Appeals; and

 

WHEREAS, your Zoning Board of Appeals (ZBA), after reviewing the testimony presented at the public hearings conducted on April 19 and May 10, 2023 on the aforesaid petition has determined the proposed rezoning meets Standards for a Map Amendment Approval contained in Section 151. 047(G)(2) of the Lake County, Illinois Code of Ordinances, and the ZBA has submitted its report thereon to the Planning, Building, Zoning and Environment Committee of the County Board, and its report recommends by a vote of 6 "Ayes" and 1 "Nay" that the petition be approved; and

 

WHEREAS, your Planning, Building, Zoning and Environment Committee duly considered the petition and reports aforedescribed and recommends the petition be granted.

 

NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that PIN 02-30-100-082 (a.k.a. 39660 N Illinois Route 59, Lake Villa, Illinois) be rezoned from the Residential-3 (R-3) zoning district to the General Commercial (GC) zoning district; and

 

BE IT FURTHER RESOLVED, that the Secretary of said Zoning Board of Appeals be instructed to notify the Petitioners as to the action taken by the Board.
