Joint resolution authorizing an Intergovernmental Agreement (IGA) between the County of Lake (through the Lake County Health Department) and the Village of Lakemoor pertaining to the delegation of enforcement authority for Onsite Waste Treatment System provisions in the Ports of Sullivan Lake.
Staff Summary
• The Ports of Sullivan is approximately 40 acres, developed as a seasonal recreational park during the 1980’s permitted by the Illinois Department of Public Health (IDPH).
• The site housed many recreational vehicles and non-permanent type structures which addressed their sanitary sewer service needs via holding tanks.
• In 1987, the IDPH became aware of significant code compliance issues that were causing enforcement difficulties as the area began to be used more for full-time residential uses.
• In the 1990s, the enforcement authority for the holding tanks was turned over to the Lake County Health Department (LCHD) and, since then, several unsuccessful agreements were made between LCHD and the Ports of Sullivan to enforce sewage disposal concerns.
• The Village of Lakemoor is desirous of enforcing specified health codes of LCHD to effectuate code enforcement with the intent of preventing environmental harm as well as to reduce or minimize potential negative health impacts on the residents and the surrounding area.

RESOLUTION
WHEREAS, the Lake County Health Department (LCHD) is authorized to enforce local ordinances to protect the public’s health; and
WHEREAS, the Lake County Board incorporated these ordinances under Title XVII of the Lake County Code of Ordinances on November 12, 2013; and
WHEREAS, the Village of Lakemoor (hereinafter “LAKEMOOR”) has territorial jurisdiction over a residential development commonly known as the Ports of Sullivan Lake (hereinafter “TERRITORY”) for all purposes authorized under the Illinois Municipal Act (65 ILCS 5/1 et seq.); and
WHEREAS, Lake County, Illinois, an Illinois body politic, through the LCHD has enforcement jurisdiction over all onsite wastewater treatment systems for residential and commercial applications within Lake County; and
WHEREAS, LCHD has tried, but has been unable to reach a sustained agreement with the association that represents the homeowners of the TERRITORY directed at ensuring the proper handling and pumping of domestic wastewater; and
WHEREAS, LAKEMOOR is desirous of enforcing the health codes of LCHD to effectuate a code enforcement program with the intent of preventing environmental harm as well as to reduce or minimize potential negative health impacts on the residents of the TERRITORY and the surrounding area; and
WHEREAS, in order to provide the authority and tools necessary to work towards compliance with all health codes within the TERRITORY, it is most expedient that LCHD enter into this Agreement for LAKEMOOR to enforce certain specified health codes of LCHD as it pertains to the TERRITORY; and
WHEREAS, Article VII, Section 10 of the 1970 Constitution of the State of Illinois and the Illinois Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq., authorize and encourage the cooperation between units of local government; and
WHEREAS, LAKEMOOR and Lake County, Illinois, through the LCHD, are authorized by the terms and provisions of the Illinois Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq., to enter into intergovernmental agreements, ventures, and undertakings to perform jointly a governmental purpose or undertaking either of them could do singularly; and
WHEREAS, the Lake County Board of Health has approved the proposed IGA on August 27, 2025; and
WHEREAS, the Lake County Board of Health has recommended that the proposed IGA be referred to the County Board for approval.
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the proposed IGA herewith be approved and made a matter of Lake County law; and
BE IT FURTHER RESOLVED, that the Lake County Clerk is hereby authorized to distribute certified copies of the amended IGA to the County Administrator, Comptroller, and the Executive Director of the Lake County Health Department.
