Joint resolution authorizing an agreement for professional engineering services with Hey and Associates, Volo, Illinois, for additional Phase I preliminary engineering and Phase II design engineering services for the design of a proposed wetland mitigation bank at the Buffalo Creek Forest Preserve at a maximum cost of services described as $170,500, appropriating a supplemental amount of $165,000 of County Bridge Tax funds for these engineering services, and designated as Section 01-00000-00-ES.

· Buffalo Creek Forest Preserve Wetland Bank: Consultant Agreement and Supplemental Appropriation.
· The County has an intergovernmental agreement with the Forest Preserve District for construction of a County wetland mitigation bank, and a site has been identified at the Buffalo Creek Forest Preserve.
· Pursuant to an agreement with LCDOT, Stormwater Management Commission has done some Phase I preliminary engineering and Phase II design engineering.
· Using the Local Government Professional Services Selection Act, Hey and Associates, Volo, Illinois, will be used to complete the Phase I preliminary engineering and Phase II design engineering at a maximum cost of $170,500.
· Appropriations of funds were approved by this County Board on October 9, 2001, for $50,000 and November 16, 2012, for $85,000.
· The total cost of Phase I and Phase II Engineering for the project is $260,700.
· This resolution authorizes a contract with Hey and Associates, and appropriates a supplemental amount of $165,000 of County Bridge Tax funds for these engineering services.

R E S O L U T I O N
WHEREAS, the construction of improvements to designated routes on the County highway system sometimes result in minor impacts to adjacent wetlands; and
WHEREAS, it is necessary to mitigate for impacts to wetlands caused by the construction of improvements to designated routes on the County highway system; and
WHEREAS, the use of wetland mitigation bank credits is an environmentally appropriate and cost effective way of handling the mitigation of said minor wetland impacts; and
WHEREAS, Lake County has an agreement in place entitled the "INTERGOVERNMENTAL AGREEMENT BY AND BETWEEN LAKE COUNTY FOREST PRESERVE DISTRICT AND COUNTY OF LAKE TERMINATING A PRIOR AGREEMENT PROVIDING FOR THE EXCHANGE OF LAND, AND PROVIDING FOR A LICENSE AGREEMENT" dated April 28, 2000, and amended April 10, 2012, for the possible construction of a county wetland bank on District property; and
WHEREAS, the District has identified a potential wetland mitigation bank site at the Buffalo Creek Forest Preserve and is also interested in the possibility of having a large enough site to provide for its own needs for wetland mitigation bank credits; and
WHEREAS, additional professional engineering services are needed to complete the Phase I preliminary engineering and the Phase II design engineering for the proposed project; and
WHEREAS, the Stormwater Management has completed some professional engineering services for the said Phase I and Phase II; and
WHEREAS, using the Local Government Professional Services Selection Act, (50 ILCS 510/1 et. Seq.) Hey and Associates, Volo, Illinois, will be used to complete the Phase I preliminary engineering and Phase II design engineering at a maximum cost of $170,500; and
WHEREAS, a supplemental appropriation of $165,000 of County Bridge Tax funds is required.
NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that Hey and Associates, Volo, Illinois, be employed to provide said Phase I preliminary engineering and Phase II design engineering services, and that the County Board Chair, the County Clerk, and the County Engineer of Lake County are authorized and they are directed to execute, on behalf of Lake County, an agreement for consultant engineering services between Lake County and Hey and Associates, Volo, Illinois, a draft copy of which is attached hereto, and such authorization shall include any necessary subsequent amendments.
BE IT FURTHER RESOLVED that the County Engineer shall transmit, in writing, the final agreement to be executed by the County Board Chair and the County Clerk.
BE IT FURTHER RESOLVED that there is hereby appropriated a supplemental amount of $165,000 of Matching Tax funds for these engineering services, and designated as Section 01-00000-00-ES.
BE IT FURTHER RESOLVED that this agreement be administered in accordance with Chapter 605, Act 5, Section 5-205.2 of the Illinois Compiled Statutes without further Board action providing the final contract cost chargeable under the funds appropriated does not exceed the appropriations provided.
