WHEREAS, pursuant to authority granted by this Board of Lake County, the County Engineer heretofore called for sealed bids by publication for the improvement of the intersection of Darrell Road (County Highway 44) at Burnett Road and designated as Section 02-00107-07-CH; and
WHEREAS, pursuant to said publication and calling for said bids, sealed bids were received and opened on October 21, 2008 at 10:00 A.M., at the Lake County Division of Transportation in Libertyville, Illinois; a tabulation of said bids being as follows:

WHEREAS, the Public Works and Transportation Committee, the County Engineer and the Purchasing Agent have examined each bid, and it appears that the lowest responsible bidder is Berger Excavating Contractors, Wauconda, Illinois, their bid being $3,179,717.76 based on estimated quantities and unit prices.
WHEREAS, this County Board of Lake County, Illinois, by prior resolution at its meeting of October 09, 2007, appropriating $1,065,000.00 of County Bridge Tax funds $640,000.00 of Matching Tax funds and $3,125,000.00 of Motor Fuel Tax funds for the improvement of the aforesaid section.
NOW, THEREFORE BE IT RESOLVED by this County Board of Lake County, Illinois, that a contract be awarded to said Berger Excavating Contractors, Wauconda, Illinois, in accordance with their bid of $3,179,717.76 based on estimated quantities and unit prices, and that the Purchasing Agent, the County Clerk, and the County Engineer of Lake County be authorized and they are hereby directed to enter into a contract with said low bidder for the improvement of the intersection of Darrell Road and Burnett Road and designated as Section 02-00107-07-CH.
BE IT FURTHER RESOLVED that the appropriation of $1,065,000.00 of County Bridge Tax funds, $640,000.00 of Matching Tax funds and $3,125,000.00 of Motor Fuel Tax funds as adopted by resolution of this county Board at its meeting of October 9, 2007 is hereby rescinded and that there is hereby appropriated $395,000 of County Bridge Tax funds, $955,000.00 of Matching Tax funds and $2,465,000.00 of Motor Fuel Tax funds for the aforesaid improvement designated as Section 02-00107-07-CH.
BE IT FURTHER RESOLVED that inasmuch as such estimated quantities are the best approximation that can be determined at this time, these quantities may be added to, deducted from, or modified from in the final determination of the contract cost in accordance with Chapter 605 of the Illinois Compiled Statutes, Act 5, Section 5-205.2 without further Board action, providing the final cost chargeable in the funds appropriated does not exceed the appropriation.
BE IT FURTHER RESOLVED that this award be processed by the County Engineer for final approval of the Illinois Department of Transportation in accordance with “Agreement of Understanding” between the Illinois Department of Transportation and Lake County dated January 22, 2003.
