•                     Midlothian Rd will be extended from the existing county fair entrance northerly to Casey Rd.

•                     The Central Lake County Joint Action Water Agency has potable water facilities situated within and along the right-of-way of Midlothian Rd extension.

•                     In order to accommodate the construction of the Midlothian Rd extension and the associated bike path these facilities need to be relocated.

•                     This resolution authorizes the execution of an agreement with Central Lake County Joint Action Water Agency.

RESOLUTION

WHEREAS, Midlothian Road (County Highway 48) is a designated route on the county highway system; and

WHEREAS, Midlothian Road will be extended northerly from the existing fairground entrance to Casey Road; and

WHEREAS, Lake County by and through its Division of Transportation has caused to be prepared preliminary plans and specifications for said Midlothian Road extension and associated bike path ; and 

WHEREAS, the Central Lake County Joint Action Water Agency (JAWA) has potable water facilities within and adjacent to the new right-of-way lines of Midlothian Road; and

                     WHEREAS, Lake County and JAWA are desirous of entering into an agreement stating the terms and conditions by which JAWA will agree to the have its potable water facilities moved by the Division of Transportation as part of the extension of Midlothian Road and associated bike path, a draft copy of which is attached hereto.

NOW, THEREFORE BE IT RESOLVED, that the Chair of the County Board, the County Clerk, and the County Engineer of Lake County, Illinois, are authorized and they are hereby directed to execute an agreement between Lake County and Central Lake County Joint Action Water Agency (JAWA) stating the terms and conditions by which JAWA’s potable water facilities will be relocated by Lake County as part of the extension of Midlothian Road and associated bike path and designated as Section 09-00244-03-FP.
