Joint resolution authorizing the acceptance and execution of an Illinois Criminal Justice Information Authority (ICJIA) Deferred Prosecution grant assisting the Lake County State’s Attorney’s Office with enhancing the deferred prosecution program and approving an emergency appropriation of $72,738 in grant funds.

• The Lake County State’s Attorney’s Office (LCSAO) has been awarded $72,738 in grant funds by Illinois Criminal Justice Information Authority (ICJIA) for Deferred Prosecution funding.
• Deferred prosecution is a postponement of criminal charges in the exchange of meeting specific conditions, usually through rehabilitative services and can occur pre-charge (deflection) or post-charge (diversion).
• The grant period is April 20, 2026, through June 30, 2026.
• LCSAO will use these funds to cover two and a half months of the salary and benefits for both our Diversion and Deflection Coordinators (position numbers 41174 and 41171, respectively) as well as 18 percent salary and benefits for our Chief Deputy of Restorative Justice (position number 41082). Additionally, trainings and outreach supplies will be purchased as part of the grant budget.
• If funding for the 100 percent grant-funded positions end, and new funding is not secured, the positions will be eliminated.

RESOLUTION
WHEREAS, the Lake County State’s Attorney’s Office has been awarded an Illinois Criminal Justice Information Authority (ICJIA) Deferred Prosecution grant, for the time period of April 20, 2026, through June 30, 2026, in the amount of $72,738; and
WHEREAS, the Lake County State’s Attorney’s Office will use this funding to enhance the Deferred Prosecution program with the funding of Diversion and Deflection salary and benefits, as well as applicable trainings and outreach materials; and
WHEREAS, the ICJIA grant is in the amount of $72,738 and it is necessary to emergency appropriate this amount; and
WHEREAS, the State’s Attorney’s Office recommends that the Chair of the County Board, the State’s Attorney and the Treasurer be authorized to execute the necessary documents to accept and execute the grant.
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the ICJIA grant awarded to the Lake County State’s Attorney’s Office is hereby accepted; and
BE IT FURTHER RESOLVED, that $72,738 is hereby authorized for the ICJIA Deferred Prosecution grant in the revenue and expenditure accounts as noted in the attached budget; and
BE IT FURTHER RESOLVED, that the State’s Attorney shall serve as the project director for the program, and accurate records of all necessary grant compliance requirements shall be kept by the State’s Attorney’s Office; and
BE IT FURTHER RESOLVED, that the Chair of the Lake County Board, the Lake County State’s Attorney, and the Lake County Treasurer are hereby authorized to execute the necessary documentation in order to accept the grant renewal.
