Joint Resolution authorizing execution of a Second Amendment to the Agreement for Sewage Disposal between the City of Waukegan and Lake County for the River Glen Subdivision.

 

Staff Summary

                     The City of Waukegan is requesting an amendment to add a proposed subdivision located at the corner of Route 120 and River Road to the Northeast Central Sanitary Sewer service area.

                     The expansion area contains approximately 93.3 acres with the north 49 acres within the corporate limits of the City and the remaining 44 acres in unincorporated Lake County.

                     The proposal is for the construction of a lift station and 6-inch diameter force main through Forest Preserve property from Route 120 to the County’s Northeast Central Interceptor sewer.

                     The proposed sewer would serve the River Glen Subdivision consisting of 41 single family homes on 22.3 acres and potential future service to an additional 160 homes on 71 acres.

                     The Planning Department has provided a memorandum on the request to examine the consistency with County and local land use designations and for consistency with the framework plan.

                     The agreement includes a provision which requires the City to require the developer(s) provide a bike path connection to the Lake County Forest Preserve District River Trail.

                     This resolution authorizes the execution of a Second Amendment to the Agreement for Sewage Disposal with the City of Waukegan.

R E S O L U T I O N


                     WHEREAS, the County of Lake owns and operates a regional sewer system that serves several municipalities                     in the Northeast Central Facilities Planning Area; and

 

                     WHEREAS, the County entered into an Agreement for Sewage Disposal with the City of Waukegan on May 12, 1992, regarding service to two residential subdivisions located in the County’s Northeast Central Facilities Planning Area, which Agreement was amended as of February 9, 1993 to permit the extension of sewer service to an additional residential subdivision known as River Bend;

 

WHEREAS, the City of Waukegan has requested the County permit the extension of sewer service to: 1) a 22.3-acre subdivision located outside of the City Service Area that is proposed to be developed within the City for 41 single-family homes and 2) an additional approximately 71-acres located outside of the City Service Areas that is contemplated to be annexed to and developed within the City for not more than160 single-family homes; and

 

WHEREAS, the County Public Works & Transportation Committee has determined that, subject to the terms and conditions set forth in this Second Amendment, the additional sewage flows permitted by the County from the requested additional areas is consistent with the “Considerations and Principles Relating to Intergovernmental Agreements for Sewer and Amendment to Existing Agreements” and has determined that the extension of sewer service to the requested additional areas is feasible; and

 

                     WHEREAS, the appropriate Second Amendment to the Agreement for Sewage Disposal has been prepared, and ratified by the City of Waukegan; and

 

                     WHEREAS, execution of said Second Amendment must be authorized by Resolution of this County Board.

 

                     NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the Chair of the County Board and the Clerk of said County be and they are hereby authorized and directed to execute the attached Second Amendment to the Agreement for Sewage Disposal with the City of Waukegan.
