Resolution authorizing an intergovernmental agreement (IGA) with Lake County and the Village of Libertyville for the use and development of the Lake County Libertyville Campus.
Staff Summary
• The County owns property located within the corporate limits of the Village of Libertyville in the northwestern quadrant of Illinois Route 21/Milwaukee Avenue and Winchester Road and is comprised of approximately 172.2 acres (the Campus).
• As a condition of the 2007 approval of a Site Plan Permit for the Lake County Permitting Facility the County agreed to prepare a Planned Development Master Plan for the entire Campus and apply for a Special Use Permit.
• The County filed an application with the Village of Libertyville seeking approval of a Special Use Permit for a Planned Development Master Plan.
• Commencing on October 25, 2010 and concluding on October 23, 2012, various hearings and public meetings were held before the Village’s Plan Commission and Village Board which culminated in the Village Board adopting Ordinances No. 12-O-65 and No. 12-O-66.
• The County will memorialize commitments to the Village of Libertyville relating to the development and use of the Campus.
• The Village of Libertyville has approved the IGA and awaits County approval.

WHEREAS, the County is the owner of certain real property located within the corporate limits of the Village of Libertyville in the northwestern quadrant of Illinois Route 21/Milwaukee Avenue and Winchester Road, and is comprised of approximately 172.2 acres (the Campus); and,
WHEREAS, as a condition of the 2007 approval of a Site Plan Permit for the Lake County Permitting Facility the County agreed to prepare a Planned Development Master Plan for the entire Campus and apply for a Special Use Permit for said Master Plan; and,
WHEREAS, the County filed an application with the Village of Libertyville seeking approval of a Special Use Permit for a Planned Development Master Plan on the Subject Property; and,
WHEREAS, commencing on October 25, 2010 and concluding on October 23, 2012, various hearings and public meetings were held before the Village’s Plan Commission and Village Board which culminated in the Village Board adopting Libertyville Ordinance No. 12-O-65 “Granting a Planned Development Master Plan” and Ordinance No. 12-O-66 “Granting a Special Use Permit for a Planned Development Master Plan”; and
WHEREAS, during the various hearings and public meetings the County agreed to memorialize certain commitments to the Village that the County was willing to make relating to the development and use of the Campus in an Intergovernmental Agreement; and
WHEREAS, said commitments have been memorialized into an Intergovernmental Agreement. The Village and the County have the authority to enter into this agreement pursuant to the Illinois Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq.; and,
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the Intergovernmental Agreement between the County and the Village of Libertyville shall be and is hereby approved in the form substantially the same as the document attached hereto; and
BE IT FURTHER RESOLVED, that the Chair of the County Board and the County Clerk are hereby authorizes and directed to duly execute and attest the Intergovernmental Agreement with the Village of Libertyville; and
BE IT FURTHER RESOLVED, that this Intergovernmental Agreement shall be executed in multiple identical counterparts, and a fully executed original copy of the Intergovernmental Agreement shall be forwarded to the Village of Libertyville for its file and use.
