Joint resolution authorizing the execution of a Restated and Amended Intergovernmental Agreement (IGA) for Sewage Disposal between Lake County (County) and the City of Waukegan (City).

 

Staff Summary

                     The County and the City of Waukegan entered into an Agreement for Sewage Disposal, dated May 12, 1992, which was last amended on February 11, 2014, to allow for the extension of sewer service to parcels on IL Route 120 and River Road, and the initial Agreement has since expired.

                     The City wishes to enter into a new Restated and Amended Intergovernmental Agreement for Sewage Disposal to continue its long-term plans for providing sewerage services for future development and redevelopment of this area.

                     The County owns and operates a system of interceptor sanitary sewers that transport sewage from the areas served in this agreement to the North Shore Water Reclamation District (NSWRD) as part of the Northeast Central Lake Facilities Planning Area.

                     The City of Waukegan is scheduled to act on the IGA at the City Council meeting on August 18, 2025.

                     This resolution authorizes the execution of an IGA between the County and the City of Waukegan.

                     In accordance with County Board Rules, the State’s Attorney’s Office has reviewed this Intergovernmental Agreement prior to action by the County Board.

RESOLUTION

 

WHEREAS, the County of Lake (“County”) owns and operates a system of interceptor sanitary sewers in the Northeast Central Lake Facilities Planning Area (“FPA”) to provide sanitary sewer service and to transport sewage; and

 

WHEREAS, the County entered into an Agreement for Sewage Disposal with the City of Waukegan (“City”) on May 12, 1992, regarding service to two residential subdivisions located in the County’s Northeast Central Facilities Planning Area, and this Agreement was amended as of February 9, 1993, April 11, 2011, and February 11, 2014, to permit the extension of sewer service to additional residential subdivisions; and

 

WHEREAS, the Agreement has since expired and the City wishes to enter into a new Intergovernmental Agreement for Sewage Disposal to continue its long-term plans for providing sewerage services for future development and redevelopment of this area; and

 

WHEREAS, the Restated and Amended Agreement for Sewage Disposal has been prepared, and will be ratified by the City of Waukegan on August 18, 2025; and

 

WHEREAS, execution of said Restated and Amended Agreement must be authorized by resolution of this County Board.

 

NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the Chair of the County Board and the Clerk of said County are hereby authorized and directed to execute the attached Restated and Amended Intergovernmental Agreement for Sewage Disposal with the City of Waukegan.
