Resolution authorizing an Intergovernmental agreement between the City of North Chicago on behalf of the North Chicago Emergency Telephone System Board and the County of Lake, Illinois, on behalf of the Lake County Emergency Telephone System Board, for 9-1-1 call handling and routing.

Staff Summary

                     The Illinois Commerce Commission requires that contiguous 911 entities have agreements with one another to send, receive, and service out of area calls.    

                     Agreements are in place to ensure proper handling of all calls as well as mis-routed 911 calls. If a call is received incorrectly each jurisdiction agrees to accept and service calls until they can be properly transferred to the correct 911 call handling jurisdiction. 

                     This updates the IGA provisions between the North Chicago ETSB and the Lake County ETSB.

 

 

Body

WHEREAS, the Constitution of the State of Illinois, 1970, Article VII, Section 10, authorizes units of local government to contract or otherwise associate among themselves in any manner not prohibited by law or ordinance;

WHEREAS, 5 ILCS 220/1, entitled the “International Cooperation Act”, provides that any power or powers, privileges or authority exercised or which may be exercised by a unit of local government may be exercised and enjoyed jointly with any other unit of local government; and

WHEREAS, 5 ILCS 220/2 defines a public agency as follows:

“any unit of local government as defined in the Illinois Constitution of 1970, any school district, any public community college district, any public building commission, the State of Illinois, any agency of the State government or of the United States, or any other State, any political subdivision of another State, and any combination of the above pursuant to an intergovernmental agreement which includes provisions for a governing body of the agency created by the agreement”; and

 

WHEREAS, the Emergency Telephone System Act, 50 ILCS 750/14, provides for joint powers agreements or other written cooperative agreements between public agencies and public safety agencies which are part of different systems but whose jurisdictional boundaries are contiguous, and further provides that “once an emergency unit is dispatched in response to a request through the system, such unit shall render its services to the requesting party without regard to whether the unit is operating outside its normal jurisdictional boundaries”; and

WHEREAS, the Wireless Emergency Telephone Safety Act, 50 ILCS 751/15, provides that two or more emergency telephone system boards or qualified units of local government may, by virtue of an intergovernmental agreement, provide wireless 9-1-1 service for the other’s jurisdictional boundaries; and

WHEREAS, the City owns and operates the North Chicago Emergency Telephone System Board, the “NCETSB,” a duly constituted emergency telephone system board with a public safety answering point (the “North Chicago PSAP”) which has both landline and wireless 9-1-1 call handling capabilities and which dispatches emergency services by means of the Police and Fire Departments of the City, and

WHEREAS, the County owns and operates Lake County Emergency Telephone System Board, the “LCETSB,” a county-wide 9-1-1 Emergency call taking and dispatching system which dispatches emergency services by means of the Lake County Sheriff’s Office public safety answering point, the “Lake County Sheriff PSAP;” and

WHEREAS, 9-1-1 calls are sometimes received by one Party that originate within the jurisdiction of the other Party; and

WHEREAS, the City and the County, pursuant to statutory authority, wish to enter into a call handling and call routing agreement whereby each Party agrees to handle 9-1-1 calls, whether by landline or wireless means, arising within the jurisdiction of the other Party and to route such calls to the appropriate public safety answering point (“PSAP”) for appropriate response, including emergency dispatch response.

NOW, THEREFORE, IT IS HEREBY AGREED THAT:

1.  All 9-1-1 calls received by a Party to this Intergovernmental Agreement that arise within the boundaries or PSAP jurisdiction of the other Party shall be either routed to the other Party or handled by the receiving Party, to insure that such calls are dispatched as necessary or appropriate for response by appropriate public safety agencies, including but not limited to the North Chicago Police Department, the North Chicago Fire Department, and/or the Lake County Sheriff’s Office.

2.  Except as otherwise may be provided by separate intergovernmental agreement between the Parties, no claim shall be made by either Party for sharing or splitting of landline or wireless surcharge monies collected by the other Party resulting from the handling or routing by the receiving Party of calls originating within the jurisdiction of the other Party.

3.  This Agreement shall be effective when signed by authorized representatives of the County and the City and will remain effective until revoked or superseded by mutual agreement of the Parties hereto.

IN WITNESS WHEREOF, the undersigned duly authorized representatives of the County and the City, do hereby execute this Intergovernmental Agreement as of the date(s) set forth below.
