Joint resolution authorizing the execution of an agreement with the Village of Grayslake for the conveyance of property at the northwest corner of Washington Street and Lake Street.

 

Staff Summary

                     The County made previous improvements along Washington Street, including the installation of a detention facility on a County-owned piece of property at the northwest corner of Washington Street and Lake Street.

                     The Village of Grayslake (Village) desires to install a new storm sewer system along Washington Street, utilizing the County’s detention pond property, that will provide improved drainage and enhanced flood protection to the Haryan Farms Subdivision and surrounding area.

                     As part of this agreement, the County will convey the detention pond property to the Village, the Village will assume ownership and maintenance responsibility over the detention facility, and the Village will grant a permanent easement to the County to protect the County’s stormwater detention volume.

RESOLUTION

 

WHEREAS, Washington Street, County Highway 45, is a designated route on the County highway system; and

 

WHEREAS, Lake Street is a designated route on the Village of Grayslake’s (Village) street system; and

 

WHEREAS, the County, in order to facilitate the free flow of traffic and ensure the safety of the traveling public, previously made roadway and non-motorized improvements along Washington Street, from Haryan Way to Lake Street; and

 

WHEREAS, as part of this previous project, the County acquired real property at the northwest corner of Washington Street and Lake Street for the construction of a stormwater detention pond; and

 

WHEREAS, the Village desires to install a new storm sewer system along Washington Street, utilizing the County-owned detention property, that will provide improved drainage and enhanced flood protection to the Haryan Farms Subdivision and surrounding area; and

 

WHEREAS, the County is desirous to convey the detention pond property to the Village and for the Village to assume ownership and maintenance responsibility over the detention pond; and

 

WHEREAS, the County will require a permanent easement from the Village to protect the County’s stormwater detention volume; and

 

WHEREAS, in accordance with the Local Government Property Transfer Act, 50 ILCS 605/0.01, et seq., the County may transfer property to the Village upon such terms as may be agreed upon by the corporate authorities of the County and the Village of Grayslake and subject to the provisions of said Act; and

 

WHEREAS, the County and the Village are desirous of entering into an agreement stating the terms and conditions for the property conveyance and establishing ownership and maintenance responsibilities for the detention pond, a draft copy of the agreement is attached hereto.

 

NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the County Board Chair, the County Clerk, and the County Engineer of Lake County, are authorized, and are hereby directed to enter into an agreement, and any amendments, between Lake County and the Village of Grayslake stating the terms and conditions for the conveyance of property located at the northwest corner of Washington Street and Lake Street and for establishing ownership and maintenance responsibilities for the detention pond; and

 

BE IT FURTHER RESOLVED, that the County Board Chair, the County Clerk, and the County Engineer on behalf of Lake County, Illinois, be authorized, and are hereby directed to execute whatever documents are necessary to effectuate the conveyance of property at the northwest corner of Washington Street and Lake Street; and

 

BE IT FURTHER RESOLVED, that the County Engineer shall transmit, in writing, the final agreement, any amendments, and any necessary property conveyance documents to be executed by the County Board Chair and the County Clerk.
