Ordinance authorizing the Lake County Sheriff to enforce the Illinois Vehicle Code on the private streets and roads in the Antioch Golf Course Community.

 

Staff Summary

                     The neighborhood association of the Antioch Golf Course Community has been contracting with the Sheriff for the enforcement of the Illinois Vehicle Code on the private streets of their subdivision.

                     Under State Law neighborhood associations with private roads can request and pay for Sheriff Deputy patrols on the private roads of their subdivision with the authorization of the County. 

                     This resolution authorizes the Sheriff to contract with the Antioch Golf Course Community neighborhood association for patrol services at the current Special Duty rate of $60.00 per hour.

                     As with all Special Duty contracts, the fee will be reviewed and adjusted annually to ensure that all associated cost is paid for by the contracting entity.

An Enabling Ordinance to Allow the Lake County Sheriff to Enforce
the Illinois Vehicle Code within the Antioch Golf Course Community

WHEREAS, 625 ILCS 5/11-209.1 authorizes local authorities to enforce, through their law enforcement agency, the provisions of the Illinois Vehicle Code (625 ILCS 5/1-100 et seq.) on private streets and roads if a written request is made by any person or board of directors owning, operating or representing a residential subdivision, development, apartment house or apartment project, containing a minimum of 10 apartments or single family residences; and

                     WHEREAS, Lake County is a “local authority” as set forth in 625 ILCS 5/1-140; and

                     WHEREAS, the Lake County Sheriff’s Department is Lake County’s law enforcement agency; and

                     WHEREAS, the Board of Directors of the Antioch Community Golf Club Association made a written request in a letter dated on March 20, 2010, asking that the Lake County Board enact an ordinance giving the Lake County Sheriff’s Department authority to enforce the Illinois Vehicle Code on the privately owned roadways within the confines of the Antioch Golf Course Community; and

WHEREAS, the Antioch Community Golf Club Association owns, operates or represents a residential subdivision containing private streets and roads and more than 10 apartments or single family residences; and

                     WHEREAS, the County Board finds that it is in the public’s interest and will enhance public safety for the Illinois Vehicle Code to be enforced within the confines of the Antioch Golf Course Community;

 

NOW, THEREFORE, BE IT ORDAINED by the County Board of Lake County, State of Illinois, as follows:

Section 1. The Lake County Sheriff is hereby authorized to enforce the Illinois Vehicle Code on the private streets and roads within the confines of the Antioch Golf Course Community, as that area is depicted on Exhibit A, which is attached to this Ordinance and incorporated into it by reference.

Section 2. This Ordinance shall be in full force and effect after its approval by the County Board on May 11, 2010.
