Resolution to vacate an unimproved portion of Emerson Avenue, adjacent to 38563 N. Drexel Boulevard, in the J.L. Shaw’s Subdivision on Fox Lake.

 

Staff Summary

                     Thomas and Elizbeth Coronelli, and Rosemary Andrews, record owners, are requesting the vacation of an unimproved section of Emerson Avenue 50 feet wide (west side) extending westerly 250 feet along the north side, and extending 272.5 westerly feet on the south side, and a width of approximately 53 feet long east side (shoreline abutting Fox Lake) and lying southerly adjacent to 38563 N. Drexel Boulevard and located at the intersection of Emerson Avenue and Drexel Boulevard as shown on the Final Plat of the J.L. Shaw’s Subdivision on Fox Lake.

                     The Board of Vacations held a public hearing on October 24, 2018, and recommended by unanimous vote to grant the vacation.

                     The area being conveyed to the petitioner consists of 16,117 square feet. 

 

                     Following recommendations by the Public Works, Planning, & Transportation Committee, the vacation request will proceed to Financial and Administrative Committee, and the County Board for final action.

RESOLUTION

 

WHEREAS, on October 24, 2018, a public hearing was held before the Board of Vacations pursuant to Section 151.204 of the Lake County Unified Development Ordinance, as amended, on the petition of Thomas and Elizbeth Coronelli, and Rosemary Andrews, record owners to vacate an unimproved portion of Emerson Avenue 50 feet wide extending east approximately 261 feet (average length) from Drexel Boulevard, lying southerly and adjacent to 38577 N. Drexel Boulevard, located in the J.L. Shaw’s Subdivision on Fox Lake, Antioch Illinois. More fully described as follows:

 

The portion of public road known and dedicated as Emerson Avenue, lying between and contiguous to Lots 19 and 20 and lying east of the easterly right of way line of Drexel Boulevard, therefore extended northeasterly from the northwest corner of Lot 20 to the southwesterly corner of Lot 19 and lying northwest of the shore of Fox Lake thereof in J.L. Shaw’s Subdivision on Fox Lake in Section 35, Township 46 North, Range 9, East of the Third Principal Meridian, according to the plat thereof recorded July 15, 1909 as document 123552, in Book “H” of Plats, pages 38, 39 & 40 in Lake County, Illinois.

 

WHEREAS, the petitioners are the owners of the following parcels of real estate, to-wit: Lots 18 and 19 in J.L Shaw’s Second Subdivision on Fox Lake, in Section 35, Township 46 North, Range 9, East of the Third Principal Meridian, according to the plat thereof, recorded July 16, 1909 as Document 123552 in Book “H” of Plats, Pages 38, 39, 40, in Lake County Illinois, PINs 01-35-202-020; and Lot 20 the northerly half of Lot 21 (except the westerly 150 feet of said Lot 21 measured along the northerly and southerly lines thereof) in J.L. Shaw’s Second Subdivision on Fox Lake, in Section 35, Township 46 North, Range 9, East of the Third Principal Meridian, according to the plat thereof, recorded July 16, 1909 as Document 123552 in Book “H” of Plats, Page 38, in Lake County, Illinois, PIN 01-35-216-008.

 

WHEREAS, after reviewing the testimony presented at the aforementioned public hearing of the Board of Vacations, said Board has submitted its recommendation and report to the Public Works, Planning, & Transportation Committee; and

 

WHEREAS, the Board of Vacations recommends approval of the vacation request based on the following findings: 1) Antioch Township has no objection to the request; 2) Antioch Fire Department has no objection to the request; 3) Without an active homeowner’s association there is no official oversight of the right-of-way use; 4) The vacation would relieve the County of any liability associated with the right-of-way; 5) The vacation would place the property in private ownership and on the tax rolls; 6) The vacation would rectify a legal nonconforming structure.

 

NOW, THEREFORE, BE IT RESOLVED by the Lake County Board that the public right-of-way, as described above, is hereby vacated and that portion of said plats of subdivision are hereby revoked, annulled, and set aside; and

 

NOW, THEREFORE, BE IT FURTHER RESOLVED, that this resolution shall take effect and be in force for and after its passage provided that said petitioner shall after the passage of this resolution, file for recording in the office of the County Recorder of Deeds, a certified copy of this resolution, the application, and the Deed of Vacation.
