RESOLUTION

                      WHEREAS, it would be beneficial to the safety and welfare of the motoring public if the traffic control signals situated along Lewis Avenue (IL Rt. 173 to 14^th Street) could be modernized and interconnected, including connection to Lake County PASSAGE; and

                     WHEREAS, Lake County PASSAGE is a cooperative initiative of IDOT and Lake County to implement the federal initiative for the Intelligent Transportation System (ITS) in Lake County; and

                      WHEREAS, Lake County by and through its Division of Transportation and in cooperation with IDOT and the City of Waukegan now desires to utilize federal highway funds to proceed with said improvement and to have provided Phase III engineering services (Construction engineering); and

                      WHEREAS, this County Board of Lake County, Illinois, at its meeting of March 8, 2005, authorized the execution of an agreement between Lake County and the State of Illinois for the costs of improvements for connection to Lake County PASSAGE associated with traffic signals owned by the state; and

                      WHEREAS, this County Board of Lake County, Illinois, at its meeting of June 10, 2008 authorized the execution of an agreement between Lake County and the City of Waukegan for costs of improvements for connection to Lake County PASSAGE associated with the traffic signals owned by the City of Waukegan; and

                     WHEREAS, Phase III construction engineering is required as part of the above-proposed improvements; and

                     WHEREAS, Lake County has selected a professional engineering services firm, Alfred Benesch & Company, Chicago, Illinois, in accordance with the Local Government Professional Services Selection Act (50 ILCS 510/1 et.seq.), for said Phase III construction engineering services.

                     WHEREAS by separate resolution, this County Board of Lake County appropriated $2,000,000 of ¼ % Sales Tax for Transportation and Public Safety funds for the construction of this improvement and construction engineering services and designated as Section 08-00259-00-TL.

                     NOW, THEREFORE BE IT RESOLVED BY this County Board of Lake County, Illinois, that Alfred Benesch & Company, Chicago, Illinois, be employed to provide Phase III construction engineering services for the traffic signal modernization and interconnection of the traffic signals,  along Lewis Avenue (IL Rt. 173 to 14^th Street) including connection to Lake County PASSAGE, and that the Chair of the County Board, the County Clerk and the County Engineer of Lake County are authorized and they are directed to execute, on behalf of Lake County, a contract for the provision of said Phase III construction engineering services between Lake County and Alfred Benesch & Company, Chicago, Illinois. The County Engineer shall transmit in writing the final agreement to be executed by the Chair of the Lake County Board and the County Clerk.  

                     BE IT FURTHER RESOLVED that this agreement be administered in accordance with Chapter 605, Act 5, Section 5-205.2 of the Illinois Compiled Statutes without further Board action providing the final contract cost chargeable under the funds appropriated does not exceed the appropriations.

                     BE IT FURTHER RESOLVED that copies of this agreement when executed in their final form be submitted to the Illinois Department of Transportation for their approval and final processing.
