Staff Summary
• In 2013, the U.S. Department of Housing and Urban Development (HUD) issued a notice stating that public housing authorities could no longer complete internal environmental review records. Instead, a “Responsible Entity” must complete environmental review records (EERs) for applicable spending of HUD funds by the housing authority.
• Pursuant to HUD rules, Lake County has been designated as the “Responsible Entity” for the Lake County Housing Authority (LCHA); the attached Memorandum of Understanding is necessary to effectuate Lake County’s “Responsible Entity” arrangement.
• To carry out the EERs, Lake County will contract for consulting services through a competitive procurement process.

RESOLUTION
WHEREAS, the U.S. Department of Housing and Urban Development (HUD) issued a notice in 2013 stating that environmental review records for public housing authority projects shall be conducted by a 3rd party “Responsible Entity” as designated by HUD; and
WHEREAS, HUD has designated Lake County as the “Responsible Entity” for Lake County Housing Authority environmental review records (ERRs) on its projects; and
WHEREAS, a Memorandum of Understanding executed by the Chairman of the Lake County Board is necessary to effectuate Lake County’s “Responsible Entity” arrangement; and
WHEREAS, by separate action, the Lake County Board will award a contract to a competitively-procured consultant to perform environmental review records on Lake County Housing Authority projects, the cost of which will be reimbursed by the Lake County Housing Authority; and
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois
that the Chairman of the Lake County Board is hereby authorized to execute this memorandum of understanding with the Lake County Housing Authority.
