O R D I N A N C E
WHEREAS, Lake County, by and through its Division of Transportation, constructed a path along the south side of Deerfield Road, County Highway 11, from Thornmeadow Road westward, to connect with the existing Des Plaines River Trail, and included the construction of a bicycle/pedestrian bridge across the Des Plaines River; and
WHEREAS, this County Board, at its meeting of December 8, 2009, approved an agreement with the LCFPD for the Deerfield Road Path construction; and
WHEREAS, the County of Lake, Illinois, acting by and through its Chair and County Board, hereinafter referred to as the County, is desirous of designating the Deerfield Road Bike Path, hereinafter referred to as the Path, as a County pedestrian/bike path from the Lake County Forest Preserve District’s Des Plaines River Trail to Thornmeadow Road; and
WHEREAS, the County needs to regulate the use of the Path for the safety and convenience of the public; and
WHEREAS, the Illinois Compiled Statutes, as amended, 605 ILCS 30/2, provides the authority to the County to regulate the use of said Path; and
WHEREAS, the Illinois Compiled Statutes, as amended, 625 ILCS 5/11-208, provides the authority to the County to regulate the operation of bicycles; and
WHEREAS, the Illinois Compiled Statutes, as amended, 55 ILCS 5/5-1067, provides the authority to the County to name said Path.
NOW, THEREFORE BE IT ENACTED by the County Board of Lake County, Illinois:
DEERFIELD ROAD BIKE PATH USE ORDINANCE
EQUESTRIAN COUNTY PORTION
SECTION 1: INTRODUCTION
The Path, located within the right-of-way of Deerfield Road, is hereby officially named the Deerfield Road Bike Path. The general location and alignment of said Path is depicted on Appendix A of this Ordinance.
SECTION 2: APPLICABILITY
This Ordinance applies to the Path.
SECTION 3: RESTRICTED USES
Said Path is restricted to the following uses:
a) bicycles
b) pedestrians
c) equine
d) all vehicles and equipment of the Lake County Division of Transportation or its authorized agents
e) police and emergency vehicles
f) vehicles and equipment of government, or private utility companies, for the maintenance of their utilities along the said Path
All other motorized and non-motorized vehicles and means of conveyances are prohibited from using said Path including but not limited to the following:
a) motor vehicles
b) motorcycles
c) motor bikes
d) mini-bikes
e) mopeds
f) go-carts
g) dirt bikes
h) all-terrain vehicles
i) equine drawn vehicles
j) snowmobiles
SECTION 4: SIGNS
This Ordinance shall not be enforceable until signs giving notice that motorized vehicles are not allowed on said Path have been posted by the County Engineer at entrances to the Path from public streets crossing the Path.
SECTION 5: ENFORCEMENT
Any full-time or part-time peace officer, employed by either the County, or by a municipality which is a party to an intergovernmental agreement with the County which grants such arrest authority, is hereby authorized to arrest any person violating any of the provisions of this Ordinance.
SECTION 6: PENALTIES
The penalty upon conviction for violating any provision of this Ordinance shall be a fine of not less than $50.00 nor more than $500.00.
SECTION 7: SEVERABILITY
Should any portion of this Ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of this Ordinance as a whole or any part thereof other than the part so declared invalid.
SECTION 8: EFFECTIVE DATE
This Ordinance takes effect on the first of the month immediately after adoption by the County.
SECTION 9: AMENDMENTS
This Ordinance may from time to time be amended as seen fit by the County.
SECTION 10: REPEALER
Any Ordinance or resolution in conflict with this Ordinance is repealed insofar as it conflicts.
