R E S O L U T I O N
WHEREAS, Hunt Club Road, County Highway 29, is a designated route on the county highway system; and
WHEREAS, in order to provide for the free flow of traffic and ensure the safety of the motoring public, Lake County proposes to improve Hunt Club Road from Millburn Road to Wadsworth Road by constructing two roundabouts, said improvement designated as Section 02-00076-13-CH; and
WHEREAS, this Lake County Board at its meeting of August 9, 2011, approved an agreement between Lake County and the Village of Old Mill Creek for a proposed multi- use trail underpass under and across Hunt Club Road; and
WHEREAS, the improvement that was the subject of said agreement was designated as a part of Section 02-00076-13-CH; and
WHEREAS, the agreement for the construction of the multi-use trail underpass was to have the construction of the underpass be within the scheduled closure period for the construction of the roundabout; and
WHEREAS, as a result of certain timing and project coordination issues, Lake County and the Village of Old Mill Creek recognize that it is no longer reasonably possible for the Village of Old Mill Creek to complete the construction of the multi-use trail underpass within the timetable set forth under the previous agreement, creating the need for this Amendment 1, a draft copy which is attached hereto; and
WHEREAS, Lake County and the Village of Old Mill Creek are desirous of entering into an Amendment 1 to the agreement providing a modification of the completion time frames for the above-said improvement, and
WHEREAS, an appropriation of funds is required for the county's participation in this improvement, and which was inadvertently left out of the resolution approving the agreement approved at the Lake County board meeting of August 9, 2011; and
WHEREAS, the said improvement needs to be designated as Section 11-00076-17-CH rather than a part of Section 02-00076-13-CH.
NOW, THEREFORE BE IT RESOLVED, by this Lake County Board, that the County Board Chair, the County Clerk, and the County Engineer of Lake County be authorized and they are hereby directed to execute Amendment 1 to the agreement pertaining to the above-named improvement and such authorization shall include any necessary subsequent amendments consistent with the construction of said tunnel underpass.
BE IT FURTHER RESOLVED that the County Engineer shall transmit, in writing, the final Amendment 1 to be executed by the County Board Chair and the County Clerk and any subsequent amendments.
BE IT FURTHER RESOLVED that $40,000 of Matching Tax funds are appropriated for this improvement and designated as Section 11-00076-17-CH.
