Resolution amending the Unified Development Ordinance related to Article 10-Subdivisions.
Staff Summary
• During the hearing, there were no members of the public to voice comments, concerns or questions regarding the amendments. Upon receiving direction by the Committee, staff of the Department of Planning, Building and Development reviewed substantive changes to the Article, particularly changes in the delegation authority for selected provisions of the text with the Committee.
• At the conclusion of the hearing, the Committee directed staff to amend Section 10.8 - Modifications and Appeals to include language that requires the Director, County Engineer and Staff Review Committee provide them notice of actions they take on minor modifications to Article 10. No other amendments to the proposed text were offered by the Committee.
• The Committee approved the proposed text amendments and recommended proceeding to the County Board for approval. A resolution approving the text amendments and a final draft of the text with changes recommended by the Committee was presented to the Committee at their February 3rd meeting for approval.
• The proposed text amendment was unanimously approved by the Committee and passed on to the County Board for final adoption on February 10, 2009.
Body
WHEREAS, Article 10 of the Unified Development Ordinance provides standards for the regulation of subdivision development; and
WHEREAS, the Department of Planning, Building and Development in cooperation with the Staff Review Committee have conducted a comprehensive review of the standards contained in Article 10 and have recommended that the text be amended in accordance with Exhibit A attached hereto; and
WHEREAS, your Planning, Building and Zoning Committee held a public hearing on January 27, 2009 to consider the proposed text amendments to Article 10; and
WHEREAS, after reviewing the recommended amendments presented at the hearing, the Planning, Building and Zoning Committee recommends that the text of the Lake County Unified Development Ordinance be amended by a vote of 5 “Ayes” and 0 “Nays” in accordance with Exhibit A attached hereto.
NOW, THEREFORE, BE IT RESOLVED by the Lake County Board that the amendments contained in Exhibit A, attached hereto and hereby made a part of this Resolution be, and are hereby adopted and made a part of the Lake County Unified Development Ordinance; and
BE IT FURTHER RESOLVED that the Clerk of the County Board shall keep a record of this action.
