Joint resolution authorizing the execution of an agreement with Commonwealth Edison (ComEd) for the relocation of transmission facilities located within the Canadian National Railroad (CN RR), or ComEd right of way, for the Rollins Road at Illinois Route 83/CN RR intersection/grade separation improvement, appropriating $3,625,000 of ¼ % Sales Tax for Transportation and Public Safety funds, and designated as Section 08-00080-56-BR.

 

Staff Summary

                     Rollins Road at Illinois Route 83/CN RR ComEd Agreement and Appropriation.

                     The intersection improvement of Rollins Road at Illinois Route 83/CN RR is included in the County’s 2012-2017 Highway Improvement Program.

                     ComEd has some transmission facilities that must be relocated to accommodate the upcoming highway improvement.

                     The relocation of the transmission facilities is proposed to be done before the construction of the highway improvement.

                     It will be necessary for Lake County to reimburse ComEd for the cost to relocate their facilities, estimated to cost $3,019,981.

                     This resolution authorizes the execution of an agreement with ComEd that provides for the relocation of their facilities, and also appropriates $3,625,000 of ¼ % Sales Tax for Transportation and Public Safety funds for these utility relocations.

R E S O L U T I O N

 

WHEREAS, Rollins Road, County Highway 31, is a designated route on the County highway system; and

 

WHEREAS, it would be beneficial for the safety and welfare of the motoring public if Rollins Road, at its intersection with Hainesville Road, County Highway 24, and Illinois Route 83, could be improved along with construction of a grade separation of the CN RR to provide increased traffic capacities (Rollins Road Gateway Improvement); and

 

WHEREAS, ComEd has transmission facilities located within ComEd right of way and within the CN RR right of way within an existing easement, all in the area of the improvement; and

 

WHEREAS, it will be necessary to relocate the said transmission facilities to accommodate the upcoming intersection improvement of Rollins Road at Illinois Route 83/CN RR; and

 

WHEREAS, it will be necessary for Lake County to reimburse ComEd for the cost to relocate their facilities, estimated to cost $3,019,981; and

 

WHEREAS, ComEd and Lake County are desirous of entering into an agreement to provide for the relocation of the said transmission facilities, setting forth the terms and obligations to each agency, a draft copy of which is attached hereto; and 

 

WHEREAS, in order to start the relocation work an appropriation of funds is needed.

 

NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that the County Board Chair, the County Clerk and the Acting County Engineer of Lake County are authorized and they are directed to execute an agreement pertaining to the terms and conditions of the above-named utility relocation. The Acting County Engineer shall transmit in writing the final agreement to be executed by the County Board Chair and the County Clerk.  

 

BE IT FURTHER RESOLVED that there is appropriated $3,625,000 of ¼ % Sales Tax for Transportation and Public Safety funds for this utility relocation, and is designated as Section 08-00080-56-BR.
