R E S O L U T I O N
WHEREAS, Cedar Lake Road, County Highway 28, and Monaville Road, County Highway 55, are designated routes on the county highway system; and
 
WHEREAS, pursuant to 605 ILCS 5/5-105, the County Board, by resolution, may transfer road jurisdiction to another highway authority upon the approval of the Illinois Department of Transportation; and
 
WHEREAS, pursuant to 605 ILCS 5/5-410.1, the County Board, by the process established by law, may surrender jurisdiction over the right-of-way and improvements of all or part of a county highway, street or road to a municipality by agreement; and
 
WHEREAS, with this jurisdictional transfer, which shall be effective upon Illinois Department of Transportation approval, Lake County is removing the portion of Old Petite Lake Road from Illinois 83 westerly 348 feet, and from Belmora Park Boulevard westerly 1,675 feet to its dead end, from the Lake County Highway System; and
 
WHEREAS, in order to ensure the free flow of traffic and the safety and welfare of the motoring public, Lake County is desirous of improving the intersection of Cedar Lake Road at Monaville Road by constructing a single lane roundabout; and
 
WHEREAS, this improvement includes the relocation of a Village watermain which lies within the limits of the County improvement; and
 
WHEREAS, Lake County will relocate the Village's watermain at no cost to the Village; and
 
WHEREAS, Lake County and the Village are desirous of entering into an agreement stating the terms and conditions for the jurisdictional transfer, the newly constructed bike path, and the relocation of the watermain, a draft copy of which is attached hereto; and  
 
WHEREAS, the Village of Lake Villa Board approved this agreement on February 13, 2013.
 
NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that the County Board Chair, the County Clerk, and the County Engineer are hereby authorized and directed to process and execute any and all appropriate and related agreements with the Village of Lake Villa for said jurisdictional transfer agreement and as required by the Illinois Department of Transportation and the relocation of the municipal watermain.
 
BE IT FURTHER RESOLVED, that the County Engineer shall transmit, in writing, the final agreement to be executed by the County Board Chair and the County Clerk.
BE IT FURTHER RESOLVED that said jurisdictional transfer is effective upon the Illinois Department of Transportation approval.
