R E S O L U T I O N
WHEREAS, this County Board of Lake County, Illinois, by prior resolution at its meeting of September 12, 2006, entered into an agreement for the use of federal highway bridge replacement funds (HBR) between the State of Illinois and Lake County for the replacement and widening of the bridge carrying Buffalo Road (County Highway 16), formally known Prairie Road, over Indian Creek; and
WHEREAS, this County Board of Lake County, Illinois, by prior resolution at its meeting of September 12, 2006, appropriated $1,090,000.00 of County Bridge Tax funds for this improvement designated as Section 00-00254-01-BR; and
WHEREAS, this County Board, by prior resolution at its meeting of July 10, 2007 approved an Amendment #1 to said original agreement for the inclusion of traffic signal interconnect cabling between the traffic signals located at the intersection of Port Clinton Road and Buffalo Grove Road to the signals at US Rte 45 and Buffalo Grove Road; and
WHEREAS, the construction and construction engineering of this project was under the supervision of the Lake County Division of Transportation, its construction engineering consultant and the Illinois Department of Transportation (IDOT) as provide for in the agreement; and
WHEREAS, this project has been completed and final costs for construction and construction engineering have been determined, including the final amount to be funded with federal funds administered by IDOT; and
WHEREAS, the State of Illinois and Lake County are desirous of entering into an amendment to said agreement providing for the final costs for construction and construction engineering, including the amount to be funded with federal funds administered by IDOT, a draft copy of which is attached hereto.
NOW, THEREFORE BE IT RESOLVED that the Chair of the County Board, the County Clerk, and the County Engineer of Lake County are authorized, and they are hereby directed to execute an amendment to the agreement pertaining for the above-named improvement. The County Engineer shall transmit in writing the final agreement to be executed by the Chair of the Lake County Board and the County Clerk.
BE IT FURTHER RESOLVED that that the Chair of the County Board, the County Clerk, and the County Engineer of Lake County are authorized and they are directed to execute on behalf of Lake County any subsequent amendments to the said agreement for this project, without further board action, for the financial close out of said project.
BE IT FURTHER RESOLVED that a copy of this agreement and any subsequent amendments, when executed in their final form, be submitted to the Illinois Department of Transportation for their approval and final processing.
BE IT FURTHER RESOLVED that this agreement be administered in accordance with Chapter 605, Act 5, Section 5-205.2 of the Illinois Compiled Statutes without further Board action providing the county share does not exceed the appropriation aforesaid.
